It probably won't work out that way. <p>1st off it really isn't 50/50 custody, its more like 51/49 w/ the primary making the call on disargements. <p>we use to have week here/ week there and it confused my D even more.. We went for standard visitation.. That is I have her every other weekend, every other Thanksgiving, the week before christmas or after on alt. years. And I get her for 2-3 every weds. <p>If I want to see her any other time I have to ask mommy. the one w/ 51% custody. This isn't a biggy as she allways agrees.. <p>I try or the D tries to call me/her evey night before she goes to bed. <p>This works well for us.<p>Tex.

I don't know how to go about getting one but I do know with children as young as you have, you can get a custody evulation. ask your lawyer.

Well, it isn't about what you want or what he wants... it is about what is best for the children. My X and I were so emcumbered by our personal battle that it was hard to remember that at times.<p>My X decided that after minimal involvement in the kids' lives that he wanted full custody. I had been at-home parenting full time for four years; most of our 5-1/2 year olds' life and all of our 3 y.o.'s life.<p>After Friend of the Court conciliation and a psych evaluation, they found that the children should live with me and that dad should get every other weekend, every other holiday, and a weekday afternoon visit.<p>Be prepared to show PROOF of your involvement, school records, letters from teachers, medical records that show YOU took them for appts, went to conferences, provide daily care, perhaps even proof of your physical and mental health, etc.
