I have been married for almost six years and have a 10 month old son. My H told me recently that he doesn't love me and is unhappy with our marriage. I am now going to counseling but he refuses to go. He says there are problems, communicating, etc. and that counseling won't help. I'm afraid that the next step is divorce because he won't even consider separating. My counselor told me today to not do anything and for him to make the first move. I don't know what the laws are in Florida but I'm scared I may lose my son. Husband's family has a lot of money and the court may give the baby to them because they have the means to raise him properly. My family has money but not as much as husbands. Also, I was diagnosed with postpartum depression after I gave birth and now it has turned into an Anxiety Disorder for which I am taking Celexa. I am doing much better now.
However, I work from home and since H doesn't work, he takes care of the baby while I am working. I have been accused by H and his family of not being a good mother to my baby. Can you use this in court in order to lessen my visitation or take the baby away from me?
I'm really scared. I want to work out the problems with my husband but he won't talk to me. I'm walking on eggshells because he blows up at me when I defend myself. We are no longer sleeping with each other because he says that we have problems.
Any advice would be appreciated.
Thanks!

Not yet, but if your H files for divorce...
...get the advice of good legal counsel.
Keep this link as a reference:Martindale-Hubbell Lawyer Search
A good place to start off is at the Martindale-Hubbell Lawyer Search site. Do a search within your county... look for only "family law" specialists(>80% in divorce/custody/etc.)... make sure they do a lot of "family law committee work"... if they know the judges all the better... You can normally find a few that will give initial counseling free of charge.
USLaw.com (an alternative search site)
In the mean time...
...follow the advice of your counselor...
Do start on a Plan A...
Check out the post Plan A - 101 (2nd ed.).

Jim / NSR

Baby
It's time you find a great lawyer, do it now. As far as your husband not working thats pretty strange. It sounds as if he is setting you up, start keeping logs everyday. Do things with the child , doctors , school, playdates. "log it". start getting smart, get ready ang keep a log.

Hi Baby,
Adams is correct, start spending time with the baby and log all activities that you do with and for the baby. I consulted an attorney when I first consider divorce because I strongly suspect my H is unfaithful. I was worried that he might try for custody of the kids. I consulted an attorney on how to protect myself. I work FT and go to school PT. That has greatly reduced my time with my childre. I was told to log what I do, since it turns out that I still provide the majority of the caretaking. My H, spends more hours with them, in respect to he is home more when they are. The time he spends doing for them and doing with them is still less than the time I spend with them. One of the things I did was I called an attorney and told him I was consider Divorce, however, I needed to know what I had to do to protect my kids since I didn't want to lose them before I file. Over the phone he told me what to do. At the time I was not looking for free legal advice. I was seriously considering Divorce, however I was not going to file until I knew how to protect my self so I would not lose the children. I'm going to stress again, find out NOW how to protect yourself. Once he files, (If he files) you may have a harder time protecting yourself.
Good luck
