Divorce was final on 8 Feb. The judge was pretty clueless. Decided he didn't have jurisdiction over the house, even thought it has always been done the same way.
The divorce was advertised in the paper for 4 weeks and that was good enough. However, he decided the house needed to be specified in the advertisement. (Duh! The advert specified EVERYTHING would be done in the hearing.)
So my lawyer had to put it (the house) in the paper. The paper screwed up & they published the court filing to have it published, instead of the actual info. So it is in the paper for another 4 weeks.
Also, they have to publish for child support. The paralegal for my lawyer tried to tell me it would be very difficult (re:impossible) to get child support since I don't know where she is & I do not know her income.
Hello?!? Use previous income tax returns from when we were married to establish a base income as allowed by law. I finally wrote a letter to the lawyer & explained this so it looks as if something should come of it. Hopefully all will be done by the end of July at the latest.
It takes 90 days in CO for a divorce and I filed Aug 17 last year. Longest 90 days I've ever seen.
The ex hasn't called in over 2 months now. Guess she forgot about her kids again.
Oh, yeah. I finally did something & got myself a real job! Woohoo! Pays lotsa money, Mon-Fri, 7 holidays, 17 days vacation to start.
A friend passed them my resume. I didn't speak to them for more than 5 minutes total. 4 very short, 4 line emails. Hired me on the spot. I know God is responsible for this so thank you God!

Hey Chris, Great news for you! It's amazing that in this day with all the divorces, there are still judges and lawyers not knowing what to do.
Happy Father's Day to you!!
How are the girls?
Bob

Chris,
Did your X show up for the D at all.
The reason why I am asking, is it sounds like she didn't show up for it.
I think I'm going to run into the same problem.
Also, as far as the CS issue, are you going to use last years income tax showing what she made in order to establish CS, and are you going to use a skip tracer to try to locate her?
Did you try hanging on to the house or not? Why did you have to advertise your house as well as CS issue's. My attorney has not mentioned any of this to me.
I'm in CO, county of Jefferson. I'm trying to hang on to the house, and have temp custody of children. STBXW left about 2 months ago, and no contact still.
Just like to know a few particulars.
Thanks!

Wallace,
No she didn't show up. Her last known address was here and she moved out 3 years ago so...
She does not know she is divorced, doesn't know I even filed.
Colorado Springs The last tax returns I have are our joint returns from 1998. I'm not too worried about trying to locate her. If I need to I can go through Child Services after a support award is granted.
I'm in the house. It's jointly owned but the VA mortgage is in her name. She has to be notified somehow (advertised since I have no known address for her to be served. Same as divorce papers.) so the court can award it to someone (me, especially since I have the kids.)

Wow. Looks like life is coming together a bit for you though I know all this clueless stuff for the legal "eagles" is enough to make you scream.
Tell these people you know where there is a perfectly good princess ready to trade jobs - but she needs to stay in Nashville or get paid enough to take on x in court. Hi Chris,
Congratulations on the job!!! I'm sorry that your xW is still incommunicado with the kids. It's hard to understand how a mother could walk away like that...
God bless you! And now you officially have my permission to go out dancing...

How goes it Chris,
Where are situated with your house and CS issues? Did you get any of those areas resolved?
I'm in a similiar situation. I filed for the "D", back in Oct. 2001 and WW's last know address is at her mothers... even though she doesn't live there. Hasn't lived there since I married her 23 yrs ago.
Mine is a no show at court as well, no contact for almost 3 months, not even to her kids.
I have been kind of foot dragging the D, only because of the legal issues that you are addressing in your situation.
If you could give me an update that would be great.
I feel for you, I know what your going through... it really makes things a lot worse than it needs to be.
Stay Strong!
Wallace

Thanks K!
I am in the Springs.
I just received a notice from the court. It is for advertising the house & child support. Handwritten on the notice is, "child support cannot be ordered without personal jurisdiction."
I think they are saying since her whereabouts are unknown, the court cannot order support. What crap.
I'll wait till after the house is mine before I do anything else (such as try to locate her.)

I wonder what would happen if this were a guy? Not that it matters, but I think there would be a lot more legal movement.
