HI, I am trying to find some answers to questions that my BIL has. He lives in Georgia, his wife had several A's and the last one was with a 14 y/o. She was charged, plead guilty and then sentenced for child molestation. She did not get jail time. Questions are: 1. Can he move out of state with their son and file for divorce in different state? 2. What is the likelihood that if divorce were handled in Georgia that she would get custody? 3. Would leaving the state with his son be considered kidnapping?
Any help would be great, need to know which directions he should take. He has been dealing with assualt and death threats from his FIL, and feels a need to get out of state.
