My stbx and MIL want to do this amicably. Other than a do it yourself divorce, is there any other way to do it amicably? My Counselor seems to think that mediation is a bad idea for me as she feels that I would not get a good deal.

Do you have to file a petition to get divorced whether or not you go through mediation? If I file a petition, does that mean that this will not be a amicable divorce? Please help! I'm very confused.

Babytoluv - Actually my husband and I filed a joint divorce petition - I actually have never wanted the divorce but he wanted it - so ok fine - we filed jointly but she is my lawyer he is somewhat representing himself - She has filed all of the papers - We agreed to everything before hand and she wrote it all up - and we are going to court on Wednesday - and it is considered an uncontested divorce so - everthing should be about two questions - Do we believe the divorce is irretrivably broken if we both answer yes then the divorce will be granted and we will be officially divorced in 91 days... Good luck - actually filing joint has so far only cost me $ 1500.00 -Hope that helped...

From what you have posted before, I would highly recommend that you get your own lawyer to represent you. Don't allow your MIL and STBX to control you. Your MIL, for example, believes that she has the right to sell your house. This is not a person who is going to amicably give you your due. She is not your friend.

When most people say "do it amicably", what they really mean is "do it my way". Don't let them push you into something that is unfair to you and your child. You didn't want this divorce, but if it must be, make sure you get legal counsel that is on your side because right now, nobody else is looking out for you.

Hi Baby,

AD said it all. As long as MIL is in the picture, they will try to control and manipulate the situation to where you have next to nothing and H has everything. I think they consulted an attorney, and maybe they didn't hear what they wanted to, so now they want to do it amicably. (which means my way or the highway).

Stick with your attorney who is looking out for your best interest.

From all of your prior posts, I see a very strong trend her. A CONTROLLING MIL. As long as stbx keeps her in the picture, she will try to have the upper hand. Your are not only divorcing your H, you are divorcing her it looks like.
