Anyone here from Alberta? And been through legal separation and/or divorce?

I just read a post over on the infidelity / in recovery board about some 90 day time period of living apart in Ontario means you are officially legally separated.

I (FWS) want to save my marriage. But my H (BS) is not interested in doing so at this point. So at his suggestion, I have moved out and we are trying living apart for 3 months, and agreed to talk after 3 months about how we feel about the marriage then.

Is there any chance he wanted me to move out so that some 90 day condition could be met and help him to get a divorce faster?????

In my Divorce Guide for Alberta book, the only mention I can find of 90 days is that if you choose to try living together again, you can do so for up to 90 days without interrupting the official separation time period. Eg. If you separated in Aug. and in Oct. you decided to try living together again, but give up at the end of Oct., your official separation date is still Aug.

But, still, if anyone here is from Alberta and knows any more about divorce law here and how living apart for 3 mos may affect things in any specific way let me know.

In Alberta.... living separate and apart for 12 months -- you can apply for a desk divorce. They mean separate and apart...meaning you don't do anything for each other (you could still be living under the SAME roof)....no cooking, no cleaning, no sex with or for the other person.

Take a look at www.albertajustice.com You can look through the divorce act and the specifics. Also there is Lawyers Referral Service through major cities in Alberta that will offer you a 1/2 hour free advice with a lawyer and you get the name of three lawyers.....essentially 1.5 hours of free legal service.

When it comes to divorce in Alberta...the majority of divorces are *no fault*. Get the free legal advice. Also you may want to check out Legal Guidance classes in the city you live in. Many major centres usually offer free services such as this through the health centres. Advice is just a phone call away.
