Hi Everyone,

I am told that OW has said she and ex-H cannot get married as planned because they will take away her Disability payments if she gets married.

Does this sound right? Does anyone know about Disability and the effects marrying someone has on it.

I mean, they are living together and have ben for 6 mos. Why would her marrying someone effect or reduce her Disability payments?

Personnally, I think someone has cold feet (Ex-H) and OW is telling people this to cover for it.

C'mon now, if you wanted to marry YOUR SOULMATE would money stop ya?

I guess I should tell you guys that I hear they are tapped out of $$ at the end of every month. They live pay check to pay check. All too common. And without her Disability pmts, they would probably be in the hole.

I work in insurance and can't imagine that disability would be reduced due to marriage. I can't imagine that it would be different for the social security definition of disability.
Are you sure she's getting it for her own "disability" or for a former husband's disability???

Hi Newly,

OW is getting Disability for HER alleged disability.

14 or so years back OW has Silicon implants installed which leaked, and she now has several things wrong with her. Funny thing is, her symptoms always get much much worse at the most convenient times, like when she was demanding my H leave me cuz she needed him.

But THANK HER LUCKY STARS! she is so much better now that my ex-H is living with her. He has such healing power. Its amazing, or maybe even a miracle. <img border="0" title="" alt="[Roll Eyes]" src="images/icons/rolleyes.gif" />

I happen to know for a fact that it is SS Disability because I saw one of her checks, it was in my H's possession before he left me for her. $7000.00 back payment of Disability funds.

So, Newly, is there any other kind of SS Disability that can be affected by income? Meaning, the pmts you receive is based on your income?

Hi Resilient! Yes, she is correct - if she's receiving Social Security. I ran into the same thing when I was engaged to a lady receiving Social Security and I was receiving Social Security - both of us were receiving Disability Benefits. Well, we checked into the Laws and Regulations of Social Security and it's true - they will take away the lesser of the Payments and pay them the higher benefit amount if they get married.
Just my $.02 from past experience.

But now I am even more confused. The deal is ex-H has a good paying job, Cisco Router Admin for the City, and OW is the only one on Disability.

So, in theory, are you saying if OW marries Ex-H that Social Security will withdraw or reduce her Disability payments based on my Ex-H's salary?

Jo, are you sure it's Social Security (SS) disability or could it be Supplemental Security Income (SSI) disability? There's a difference, although both are administered by the Social Security Administration.

Social Security payments based on disability would come from taxes she paid in while she was working.

Supplemental Security Income is basically welfare, and takes other income and assets into consideration when determining eligibility. The federal government took over the welfare old age and disability program from the states almost 30 years ago, although the states still handle their Medicaid programs.

So, if she is getting SSI, she could lose her benefits because of your ex-H's income.

And she wouldn't be eligible for regular SS because she has never worked, hence she never paid into taxes.

Well Dang too! I'm thinking if they are really "IN-LOVE" and "SOUL MATES", why should money or lack thereof stand in the way of them marrying? I mean, if this woman could frequent bars every night, why the heck can't she get a job so they can marry.

</font><hr /></blockquote><font size="2" face="Verdana, Arial">Something doesn't sit right with me here. The above bolded info says that she should still not be eligible, married or not, for SSI, since she is co-habitating with my Ex-H who is making a BIG salary.

Some people are such scammers of the system, mis-using it, and taking advantage of every loop-hole ... like having babies every four years to further Welfare benefits.

What's amazing to me is why are they so allergic to working to EARN their money?

And I am also somewhat offended at the idea that I am funding this type of unethical mis-use of a Welfare Plan that was originally setup for EMERGENCIES (temporary safety net) and not a WAY OF LIFE. Ughhhhhhh!!!

That's exactly why she can't get a job, it would interfear with her bar time.

Jo, the reason she can still get SSI is because as long as she and your ex aren't married, he isn't legally responsible for her bills and she has no legal claim on his income.

However, it may be that co-habiting with him could affect her disability payments. I'm not sure how the program is set up, but if your ex is paying the house rent, utilities, groceries, etc., then those payments should be considered as income to her, which could then reduce her SSI payments.

The problem is in how to prove that he is providing these things for her. I suppose a discreet call to the Social Security office might start an investigation into their living arrangements, but I don't really know how that works.

I agree that this kind of situation totally sucks. She's getting the benefits of his income while ripping us taxpayers off at the same time.

Hmmm! I suppose I could look it up...may just do that to satisy my own curiosity.

BTW, if she is getting food stamps, she IS required to report his presence and income. If he has a big income, she would be committing food stamp fraud by not reporting her living arrangements.

Thanks very much for the URL, Lady Clueless. VERY informative!

I see now that if she was to be investigated, she would more than likely be subject to losing at least 1/3 (one-third) of her SSI. Basing it on the fact that someone else (non-spouse) is providing food, shelter and clothing.

I also see where they talk of objects of non-modest value (i.e. jewelry etc.) which she has received a very expensive OBJECT from a person (non-spouse), that could affect the SSI.

Just amazing stuff.

"I'm on Welfare but I'm wearing a $3.5K ring, booooo hoooooo ......"

Although tempting, I'll let God handle this situation, Lady Clueless ..... it's one of those put it in God's in-box and forget about it.

Hi Resilient! Sorry it took me awhile to get back to your question. Looks like some of the other posters answered it for me. I can only tell you what I learned from my situation back right after I got divorced in '98 and was considering marrying a lady who was also on SSI. I'm on SS Disability - from injuries I received in Operation Desert Storm. I have BiPolar Illness as well as Narcolepsy - the Sleeping Illness. SS pays me for that. The lady I was engaged to has BiPolar Illness, so we both clearly had disabilities. We checked into the Rules, etc. for SS & SSI and were told that if we married, we'd lose her (the lesser) Benefit Payment, and we'd only have my payment as a married couple. I do know that SSI is based partly on need, and if this person you're talking about actually does have a verified Disability that she's being paid for, well, I would not want to give you false information. I can tell you lots about regular SS - I would advice you to visit the SS Website and also having a little 'discreet' call to your local SS Office for a new Investigation on this person certainly wouldn't hurt anything either...
And the other posters are right - there are lots of folks scamming the Federal Gov't out of Taxpayer $$$.
