I e mailed xH yesterday asking how he was filing his taxes. Needed to know how I was to claim the monies paid me before the divorce was final. Either child support or alimony, there was no distinction in the amount that was given each month. We should be on the same page though. Child support I don't have to claim alimony I do. xH didn't get back to me in time so I told tax lady to say child support, today!

I opened the e mail that xH replied to tonight, first line "I am filing jointly w/C##@!" Duh! is all I could think of!

When I replied back I did write "It is funny how you can be married to me the majority of the year and yet file your taxes with someone else" I know that it was not nice but I couldn't resist!

I'm so glad that you can laugh it all off. I will look to you as my role model when it's time to deal with all of this crap. (at least when I do my taxes, I don't have that same issue for 2002, as H hasn't given any money for me OR the kids, period. <img border="0" title="" alt="[Confused]" src="images/icons/confused.gif" /> <img border="0" title="" alt="[Frown]" src="images/icons/frown.gif" /> ).

Well, that kinda solves the background questions...it sounds like he's been supporting her...gee...I wonder...what is her income?

Check into...is your child support based on his HOUSEHOLD income? That's supposing she is working, but if she is, you may be able to draw child support on HER salary as well.

I have a cousin who never remarried, just so her lesser incomed spouse could never use her income for his next family.

Since all hope of your X being a good guy is long gone...accessing her income seems appropriate, if possible?

Your X was just so dang broke...if she has any income that is now his "joint filing", well?

My CS is on his and my income only, I have the worksheets that they used.

xH did finally call back Friday, three messages and 8 hours later. (I didn't check the e mail before I left.) When he asked to speak with me, I told my D to tell him I would call back later, I didn't!!! I e mailed and said that it was too bad that he hadn't gotten a hold of me earlier, as the tax lady needed to know how he was claiming the monies sent me from Jan til the divorce was final. That I told her they were child support and that I would not be claiming any income from them. From my understanding he has to pay taxes on that money as to if it was alimony I have to pay the taxes!!! Mmmmmmmmmmmmmm too bad he didn't respond sooner!!!!

I am waiting for the lawyers fees to be taken care of, and then I will set back down with the man and look at the law of suing for alienation of affection!!! I guess it still bothers me that there have been no consequences of her actions.

H left an e mail the other day as to when it would be best for the kids to call, and all I could think of was when he left his schedule is "Doesn't sound like much has changed in his life, just the bed partners"

Oh well, shucky darn!!!

Ah, but Dawn, he wasn't married to her when they figured the child support...worth a call to a lawyer?

Maybe while you are inquiring about Alienation of Affection Law? You are a resident here, does it matter if she wasn't? I really don't know.

If his schedule is full, the newly married OW will be a lonely lady, unless her sis is still living with them? Maybe that's why your H keeps a full schedule...hmmm?

Yes the sis and screaming kid are still there, I had to call tonight. Need the Lawyers check and wondering where the CS is, said he sent it to the state on the 1st, means it'll be another week before I see it!!! UGH!!!

I had a question for the lawyer anyways, I hate calling, the phone call alone cost me $25!!!

I was truly amazed at how much I am getting from x, when OD was figuring her taxes she asked what the total was that dad sent each month. I am getting close to half of his take home!!! Oh Well, shucky darn!!!!

I must have a mean streak, I'm delighted that the OW's sis & screamer live with them. XH must feel like home is a cozy retreat from the world--NOT!

It is nice half his take-home pay is making its way to your house and his kids.
