I am planning to go overseas with my 20 months old. I have a passport for him and am getting a visa for him as well. My D is not final yet, I have a certified copy of the most recent court order that states that I, the petitioner, have an order for protection that includes the baby, against my H and that I have temporary sole physical and legal custody of my son. My question is do I still need a letter of permission from my H to travel with the baby? How strict are the airlines? Any help is appriciated.

hmmm, best answer is to call your lawyer... Do you have joint legal custody of the baby? If so, even with a restraining order he still has the right to where the baby is at.

I was going to post the same earlier. Call your lawyer and find out for sure. The last thing you want is to get to the airport and be prevented from boarding.
Your lawyer should draft a letter to be signed by your X to allow you to take the baby. Domestically, they require no proof of a child's identity when flying (although they say you need a birth certificate). I've drag my girls all over the states with no problems.

Ironically, my attorney doesn't know. He said to call the airlines, the airlines said I just need a passport and a visa. The X wont sign anything like that, are you kidding? He is sooooo angry about the whole thing and angry that the judge ordered supervised visitations that he refuses to see the baby. Do you think he'll sign? I doubt it, just out of spite, he is dragging the divorce out and is being very vicious, asking for 1/2 of what neither he nor I own.
