For all of those that had posted on my earlier thread about FMM's XW not wanting to cooperate in voluntarily changing the scheduled days of visitation, I thought I'd give a brief update.
Court was scheduled for this Thursday, however the judge moved it up to today.
His motion to change scheduled days of visitation went through, the right of first refusal was added as well.
XW's Motion for contempt was DENIED as was her request that he pay her attorney's fees. Also all the threats to try and have judge do something against me for practicing law w/out passing the bar was all a bluff. The fact that I prepare all his legal documents was not even mentioned.
Her atty seemed really pissed w/ her. She actually wanted him to ask the judge to forbid me from brushing the child's hair while in our care . The atty stated he was not going to waste the court's time w/ such foolishness.
So she has to pay the $1,500 in atty's fees herself. We now have the baby every week M-F (starting Thursday)from noon till 8 p.m. and our regular 3 days per week (however, the days were changed to reflect his new work schedule).
So we got far more than what we intended. Had his XW just changed the days on her own we wouldn't have the baby every M-F now. So I guess there is some justice after all.
We have court for his son on 7/22. Hopefully that will go just as well. For all those that posted well wishes, thank you. tew <small>[ July 08, 2003, 07:18 PM: Message edited by: tewjtm ]</small>
