Could someone help clarrify the distinction...I do not in my heart want D, but my Attny says this is the only way to address custody...My W wants to keep one son in Fla..while my other two children want to go back home to De. w / me...I want to fight for my young son...My W is being selfish and wants to keep him w/ her...

A legal seperation is basically an agreement between two parties on how to divide assets, debts, properties, etc. while still maintaining a legal marriage. If there are minor children involved then custody of the children will be a part of the legal seperation including child support, visitation, health care, and the rest. However, both parties must be in agreement and sign to all provisions in the legal seperation. If you and your spouse cannot come to agreement then the only way that you can force custody for one of your children is to file for divorce and make your case in court.
