I contacted a lawyer in Oct. and he is being so slow. He was supposed to serve my husband his papers at least 6 weeks ago and still hasn't done it. I keep calling him and he always says he'll have them out by the end of the week. I'm getting tired of waiting. My husband still has lots of stuff at my house and he refuses to take care of anything until he get those papers. He also has little jobs around this house that he said he would take care of that he refuses to do now. Now he's threatening to file divorce against ME if he doesn't get them by the end of next week. He keeps asking for the name of my lawyer. Should I tell him and let him keep bugging the lawyer instead of me? I'm not sure what to do next? thanks. Mary.

I had to change lawyers when my lawyer failed to schedule things or communicate with me. I think some lawyers take on too many cases, and leave the little cases to fester. They forget they are dealing with people's lives. Call the office and light a fire under them, if they are still unresponsive, change lawyers.

My lawyer has been moving at a snails pace as well. He sent my WW the Notice of Service papers to sign in November and said he just received them back yesterday. I noticed she had signed them Dec 9th and supposedly her lawyer sent them to him Dec 17th so I'm not sure if I should even believe that he just got them yesterday.
Pestering your lawyer is the only thing I know of that you can do other then threatening to have someone else handle your case.

i'd get another lawyer. they vary widely in quality of service. even if you get him to act on this now, do you really want to fight this battle every time something needs to be done? the quality of service of your attorney can make a huge difference on the level of stress this whole process involves.

It works even better if another lawyer requests them on your behaf.

My second lawyer kicked A**. Had he been my first, it wouldn't have dragged out so long. I believe my first lawyer set me back 9 months. And the resulting costs were expensive due to a custody battle. Trust your instincts here.
