Hi again. I am a military bs and need help. H is military and is in another affair. We are legally seperated and he sent me an e-mail informing me that he has another woman. This is his second. She is a soldier and h is being investigated for sexual misconduct.

I just need help with what to look for in a lawyer and questions to ask pertaining to military divorce.

Thanks,
Lunadove

I am also a Military BS but my WS is a civilian, JAG won't help with any type of separation and I think you need to go to some type of counseling before they will even think about speaking to you for divorce stuff. If everybody involved is military check Article 134 UCMJ it should cover adultry.

I am civilian. H is military. We already have a legal sepperation in place and attended one counseling session for that.

We don't need counseling for divorce.

I didn't understand your post at first but I read it again and now I understand. Your h being Military has nothing to do with what questions to ask a lawyer. You can check with Family Advocacy on the nearest Post for some answers good luck

Luna,

Save the e mail, make sure it has a date on it. If you want to cause trouble for WH you can, by sending a note with that e mail to his commander, the IG were he is stationed, and any one else that you can think of.

If that is not what you want to do then don't. Save the email anyways so that you have it for documentation.

As far as the lawyer, if I remember correctly you weren't married 10 years, right? There isn't much the military is going to give you til the 10 year point. You do want to make sure that your son maintains his benefits, child support should read that support can come out of WH military check and his retirement check. This is the only way the military will garnish wages if support is not being paid. Have it in the decree that your son is the only one listed on SGLI, if WH wants someone new to have his insurance he will need to pay for a new policy.

As far as a lawyer and questions. Ask if he can explain to you what a Military Pension Division Order is, if he can that is good as he has dealt with military divorce before. The military won't give it to you but the state that you live in can give you a portion of his retirement pay through this order but it has to be in place with the decree, if I am not mistaken. I think you said that he wasn't career minded, but you never know it's better to put it in place now!

I am sure you were hurt by this latest e mai and for that I am sorry, but you are the one that has the conbtrol as to how long you are going to allow it to hurt!!!!
