Oh hey… I almost forgot. I spoke with my attorney about a few things yeaterday with regards to the original topic of this thread. I found out that Adultery is still on the books as a law in Minnesota (MN Statute 609.36, subpart 1) and was wondering what it takes for someone to be charged with it. Her reply was “…uhhhhhh an act of God.” Then I told her about the $576K awarder in the case D2IA mentioned in the opening post. She laughed and said “Yeah… in North Carolina!!! Remember what state your in here…” I told her that I didn’t even care if we won… I just wanted it all over the news for 24 to 48 hours… you know 1 or 2 news cycles. She just laughed at me… and told me that if I wanted to bring a lawsuit against him there was nothing stopping me, it is just a matter of how much I want to spend. Then she said, “How about if I just give you the forms and show you how to file it yourself…. You just have to promise me you will wait until after the divorce is over, ok?!?!?!” She agreed that it was perhaps a little vindictive, but not petty. In her words, “…if he drove over your foot by accident and you wanted to drag him into court that would be petty. This guy conspired and acted to destroy your marriage and family… I don’t think it is petty at all.”

So… that kept a smile on my face for most of last night. Also, I think I might lob a call over to the Isanti county attorneys office to see… exactly what does it take for them to charge someone with adultery…. Geez, it sure would be nice to see the ole’ WW along side the road picking up trash or something as part of community service ya know…

WMWB???: A law suit for adultery! Go for it! I will be checking to see if that is an option here.

Not actually planning on doing anything physically harmful, unless given a legal opportunity. Then we will see who can kick whose @$$. In Maryland I think the charge is a $10 fine. <img border="0" title="" alt="[Roll Eyes]" src="images/icons/rolleyes.gif" />

The OM will get his. One way or the other he will get his. Sadly to say, WW is going to get hers too. That's just the way things go. They will both live to regret it.

No, not a lawsuit.... criminal charges. I would love to see her in court... then picking up trash because she decided to be a tramp and throw out her vows. That would be the sweetest revenge imaginable... <img border="0" title="" alt="[Cool]" src="images/icons/cool.gif" />

...and to have it on her perminant criminal record... I'd like to see her parents rationalize a way for it not to be an affair then. B@stards.

You cannot file criminal charges. Only the state can file criminal charges.
And th elikeyhood of that happening (for adultery) are pretty darn slim.

So, you are saying that piling snow in her driveway with a dump truck was counter productive? Maybe so, but I got a great laugh out of it. So would that be considered good theropy? I've been over my divorce for some time. Life is good for me now. However, I do beleive that every effort should be made to repair the marriage if possible.

My attorney just happens to be a deputy prosecutor too, and I work with them regularly w/ my job. This might get real interesting here.

LL: If some seem pyschotic, could be we are just venting with dark humor, could be the male testosterone thing, could be we have been driven there by WWs, or any combination.

609.36 Adultery.

Subdivision 1. Acts constituting. When a married
woman has sexual intercourse with a man other than her husband,
whether married or not, both are guilty of adultery and may be
sentenced to imprisonment for not more than one year or to
payment of a fine of not more than $3,000, or both.

Subd. 2. Limitations. No prosecution shall be
commenced under this section except on complaint of the husband
or the wife, except when such husband or wife is insane, nor
after one year from the commission of the offense.

Subd. 3. Defense. It is a defense to violation of
this section if the marital status of the woman was not known to
the defendant at the time of the act of adultery.

I don't think it will go anywhere, but I going to try like hell. Even if she did claim insanity, that sure would put a major crimp in her trying to take the kids from me. I'd like to see the courts give custody to someone who is self proclaimed insane. And if she fights and loses... well, I'll even take the kids to visit her in the clink.

And, as it is in most states, proving adultery is really, really difficult. Pretty much all she has to do is say they never had sex.

Nope, wouldn't fly either Dead... We hung out as a nieghborhood all last summer. He came to our sons birthdays, to my birthday party, he has been to our house a hundred time (that I know of... <img border="0" title="" alt="[Roll Eyes]" src="images/icons/rolleyes.gif" /> ) everyone knew we are married. Hell, he is the one who convinced her to file (I can't prove that... but it makes sense) for D. Besides, I dragged the kids down to his house the week after D-day(WW decided that I wasn't going to pick her friends, she was denying A at the time) and told him I knew what was going on and that I loved my W. I asked to to take a look at my kids and to please not destroy their family... that I loved my WW and wanted to work on our M and couldn't do that if he was still in the picture. The @ssholes response..."Whatever dude..." then he slammed the door.
