Hi, it is me again. I am just wondering if anyone knows about how much we are looking at for back support. The OW hid the fact that she was pregnant until it was convenient for her, and now the OC is almost 3. She used medicaid and welfare probably since the baby was born. I don't know if they are looking for back support or just all the monies paid out to her. Does anyone have any idea at what we could be looking at? I am terrified it is gonna be like 50,000 or something. Please help me. I am absolutely sick to my stomach today because of this. Somedays I wish I was single. [Linked Image from marriagebuilders.com] But, of course I really don't. Thanks and hope everyone has a nice day.
happy_girl

Hi Happy_girl
From my understanding of SC laws, the OW can not sue for back support for the OC. CS use the date that the CS papers were severed.
We were served with CS papers in December, but when we requested a DNA we were told that back support would start from December, when we got the CS papers(OC was already one year old).
H took test in January, but OW and OC have not. From talking to CS, the case has been closed due to the fact that the OW did not want to do the DNA test.
I hope that it turns out the way that you want it to.
ITS

I do not know in what state you are in, but I think is a federal law, anyways you will only pay CS from the moment you were served the papers. I would get a DNA test immediatelly. In my case the OW and OC were forced to have the DNA TEST or they would drop the case against him, and she would loose all her aide.
ITS,
Do you or your husband ever see the OC? If so, a simple swab on the inside of the OC's cheek, plus a cheek swab from your H, would be enough to establish paternity.
If the OW has backed down on the DNA test, there's a good possibility that the child isn't your H's. This, like popeye's case, could be an opportunity to sue for attempted fraud. After reading this forum for awhile, I'm starting to wonder how many of these OWs are trying to perpetrate mispaternities.
Bystander

Bystander,
My H sees the OC when he can. He works out of town and he wants to work on our relationship first. I know that there are times he wants to go and see him (at the OW mother house) but he does not say anything because he does not want to hurt me. I ask him sometimes if he went to see him or call to check up on him.
My H said that if he gets a chance, he will take the OC and have that done.
We feel that we do not want to make things worst for the OW if the OC is not his. All that we would ask for is to have my H name remove from the birth certificate.
ITS

Happygirl, in my state, back child support can be collected from the date the paperwork was filed. However, in the case of mothers receiving state aid, the government usually tries to recoup all monies spent on the child, and is quite diligent about going after the fathers. A call or visit to your family court information section can provide you with a lot of answers about percentages and such. I found the family court quite helpful in my quest. I don't think back monies to the state are due upon demand; a payment plan is usually established, as in back payments to the OC.
I know someone in your situation. The case is still pending, but the state is looking for back money for the 10years OW/OC collected welfare/medicaid plus they are going to set up child support payments for the next 11 years. Both must be paid.
Ahh, to be single again! Please don't worry yourself sick over this. I hope it works out in your favor.

Once again thanks! I know that I was lucky enough to find you all for a reason!! Thanks be to God.
We are quite sure that the OC is his, because his brother saw her and said she looks like him. We will of course request a DNA test and pay for it, since that is our responsibility. I can't tell from the court papers if we have to pay back support, it just says something like it can't be more than what the state paid out to her. So, maybe the back payments will just be to the state. We are in ARIZONA. Anyone else dealing with this in AZ??
I just can't imagine what we are up against. So much for school and having a house someday. I don't really want to be single, I love my husband, he really is a wonderful man. I trust him and love him and can't imagine life without him. But!!! the thought does cross my mind once in awhile.
Thanks again all for your help. You are all in my prayers!!
happy_girl

i read one of catnip's posts and it freaked me out. i wonder how much we will have to pay now. my husband makes about 2000-3000 per month, depending on how construction is going. i am so tired. the past 3 nights i have slept but i wake up and feel as if i haven't slept at all. i have some kind of mini panic attack at work yesterday. and everyone kept telling me how tired i look. this is so stressful. i just can't stop worrying. i put our info in the childsupport calculator for AZ and put that the OW makes min wage 40 hrs a week. we know she works but not sure how much she makes. it said the monthly support would be $450. but who knows. and what about all that back support?? please help me.
a very tired and sad happy_girl
