thankyou Texas girl you are always so helpful and supportive. I make maybe 20 to 30k more than my husband (we are in the 30% tax bracket.) Our income tax is done combined we have a joint checking account. Will my income be counted in to child support? In NY can you sue for "alien of affection"? It hasn't come down to that but I'd like all my options to be out front. We have never even discussed visitation or that kind of thing _ that I'm not ready to deal with though I did say I would adopt the baby - even though it would certainly cause a lot of questions as my 4 children are all adopted from Asian countries but I would do it if it meant saving my marriage. My husband is slowly coming out of the fog and I have not told him I am going to the laywers _ I am keeping my cards close to my chest for now. He has been too conflicted and I am doing my best Plan A and avoiding confrontations.Can I force them to separate at work because he is her superior without causing his career any harm ? I doubt it which is one of the reasons no one knows I guess. Any comments would be appreciated thanks<BR> kris

Your salary won't be included per se, but when the examiner sees your income on the tax return, he won't be so willing to give your H a break, if there is a break to be given. Have you thought of filing separate returns this year? Since OC won't be born for some time, by the time OW files and you wait for DNA results they will be using 2000 tax returns anyway. It may cost you a few more dollars to do Married filing Separately...but do the math and it might be worth your while to shield your income from his court proceeding.
