Well we are going to go see a lawyer tomorrow afternoon. We have never seen one because we couldn't afford it. We still cannot afford it. But I am hoping to get some advice so that maybe we can stay on track. Our problem is we are playing russian roulette.
On one hand, we are waiting to see if my H might get this job. If he does then we have to stop the appeal, and sign off on the amount so that it won't go any higher with the new job. If she gets her cut of the new job salary, then we will be in the same position. We would not be able to pay our bills. So we have to hurry and get it done. Which of course will be hard to do without her finding out because she works at the same place as him.
Second, we really think the amount should be lower because of us not being able to pay our bills.
Can you give me some sample questions that I need to make sure and ask the lawyer? I am going to ask about lack of contact. I also want to know that if we move and tell the child support department if they automatically call up the witch and tell her. Which would of course defeat our purpose of leaving this town. Any input would be appreciated. Thank you.
babstr.

Dear Babstr:
These are the things you should ask him:
1.) What is the percentage of his income that is going to be accounted for?
2.) Do you have to put the OC on your insurance and if you do does that amount decrease.
3.) Can you request NO CONTACT what so ever.
You only to pay to the agency they per her.
4.) Will you owe any back pay? and how can you arrange a payment plan.
5.) If he is not currently working on what type of income are they going to estimate the amount of CS.On his past 1040?
When it comes to moving away, all you have to do is contact the CS agency and inform them were do you want the bill to be sent to.
You really do not have to tell the OW ANYTHING once it is in legal hands she need to back away form you guys. The only people that should be contacting you is the CS agency period. The OW has NO RIGHTS is the OC not the OW remember that. Eventhough she is the mother it does not matter, the only responsability your H has is to financially help support the child not her period, nobody can force him to have any visitation or any affection or to share custody that is a choice, but ask him that to.
Well I hope this helps a little bit, I know you will feel so much better after talking to your lawyer. If it helps any I will tell you that our lawyer handled EVERYTHING your H does not have to present himself in court or anything, our lawyer filled the paperwork, if they asked about me and my income he said that I was an innocent party in this situation and by law I do not have to tell them anything about me or what do I do or how much do I make. He charged us 800 dollars for the whole thing. He also reccomended us NOT to appeal and to go by the "chart" on CS payments, he told us if we appealed it then the judge is the one who gets to decide and most of the time you end up paying more.
Okay that is all I did I hope it helps!
I will be praying for you!
fambis
