Hey, Catnip and others wishing we could sue the scuzzy OW/OM in our lives--<P>How about this?!! Surely there are attorneys out there who are also casualties of their spouses' affairs. If we could locate some, perhaps they would be more willing (or even enthusiastic) about filing personal injury suits against our spouses' affair partners. <P>Some of the attorneys I have spoken with are so SMUG and imply that they are much too busy with cases that REALLY MATTER to bother with lowering themselves to become involved in something as trivial and distasteful as adultery. <P>Since I do not have much experience with lawyers, I never really understood why lawyers are generally considered to be slimy. Well, I understand perfectly now. I've even wondered if the reluctance of so many attorneys to take on a case like ours is because THEY are OW or OM themselves.<P>ANYWAY....the problem is, how do we locate lawyers who are victims of adultery in their own lives? Somehow I don't think we'll find that info in their bar association credentials. <P>Ideas, anyone?

Ladies:<P>The Dallas trip has been postponed one week as the attorney's wife is scheduled to deliver a baby by C-section that day. We will meet with him the following Friday, September 22.<P>When we meet, and after our depositions, I will ask him if he has any like-minded associates anywhere else in the US. <P>I'm glad you are all fired up about this. I hope we can dissuade potential OW's from allowing this to happen...<P>Catnip =^^=

Okay, Weep, you caught me!<P>While I am not fully qualified to answer questions about family law, I am fully qualified to deal with my H and the OW -- I am a criminal lawyer -- and I can't think of two bigger criminals!<P>Seriously, the downside of being a lawyer in this situation is that I examine every incident as if I am preparing for a case. I catch my H in the smallest things because I have been trained to pick up details.<P>So if any of you ever decide to act on your hatred of the OWs in your life, and you need a good legal defense, I'm here for you!<P>- Heavenly<BR>

The XOW (the bane of my existance) is right there in Long Island. <P>I cannot sue her for Alienation of Affection in your state, nor could I effectively sue her for Personal Injury given the fairly liberal laws there. However, because my husband met her in Texas, and she conceived the child in Texas, I can sue her in Texas, even though she is a NY resident. Two of their encounters were in NY.<P>Texas law makes it possible for me to sue her for Personal Injury. The attorney I have says I have a very strong case. On Friday, September 22, my husband and I will fly down and meet with this attorney and determine just how sound a case it is and proceed from there.<P>I don't know, Heavenly, this may be an exercise in futility, but if I can give her one moment of heartburn for what she has done to me, it will be worth it. My husband is really pushing me to do this, too. He's so upset with her putting that phony OFP on me and then having the Judge increase it two years for complying with the laws of NY state by sending her a certified copy of the CS appeal to the Judge, well, it's just too much. It defies logic. I would like to report him to the Judicial Review Board...got an address? <P>The attorney in Texas says because I have phone records showing that I called her one week after their first encounter begging her not to see my husband, that he was sick and I wanted to save my marriage, that this is good evidence. Because she also threatened to 'kick my [censored]', it strengthens my case. Oh, there's a lot more to all this but we'll see what happens. <P>It all seems so stupid to me sometimes, yet, I think the time has come to mix it up a little and strike back. Does anybody know if because we were not married at the time of affair if I would be able to sue? We had been living together at the time 4 and half years and have a daughter together and she knew all this. This was something I wanted to do from day one. Thanks Flowerseed<P>------------------<BR>
