Hello All:
My H has a 3-1/2 y.o. daughter(OC). Now, when the OC was conceived and born, the XOW was married but separated. On the child's birth certificate, XOW had to put her H's name on it because she is still legally married. I have no doubt that this child is my H's. She looks just like my H and both of my boys.
Should we worry in the long run about paying child support? We have tried on numerous occasions to give her someting on our own, but she won't accept it. If she tries to come back at us saying that we never tried, what do we do?
Just curious.
Sunshine504

SS:
You are fortunate that the OW has had her husband's name on the birth certificate for the past almost four years. Depending on what state you live in, this could be quite a coup for you and absolve you and your husband of financial destruction.
Get some legal advice about this-fast. Depending what state you live in, you could be off the hook. I envy your position as I am at the other end of the spectrum with NY State requiring us to pay around 60% of my husband's gross salary every month with 'arrears' multiplying at an alarming rate, causing us to file bankruptcy and to divorce to protect me.
Wanna trade places?
Catnip =^^=

Sunshine,
I'm in the same boat. My H OC is now 4 years old and is just now suing my H for paternity. He took a DNA back in July and we just got results. He's 99.5% positve that it's his. He now has to go back to the city where the child was conceived (where OW and OC live). The OW was also married but seperated (maybe) during the time that she slept with my H and conceived this child. The OC last name is the same as OC and her H. I don't know what this means (if anything). But I have an appt with an attorney later this week (free consult), so I hope to find out. If he has to pay child support, then so be it. It's the price he has to pay for sleeping with the tramp to begin with. But I still want to know if it may make a difference. I'll let you know what I find out...please let me know if you find out anything. I'm in Florida so the laws may be different than in the city you live in.
Comfort

Comfort has the right idea on this. Contact a lawyer and get set up for a FREE consultation. If you are in the same state as ow and oc they can directly give you info and advice.
If ow and oc are in a different state still set up the consultation and if they do not know the laws for the state you are looking for they have a book with a list of lawyers in any state. You can give these lawyers a call. Make sure that you do not pay for a phone consultation.
I did this exact thing and I live in Georgia. I actually had one lawyer in Arizona try to charge me 75$ for a phone consultation. What a rip! A decent one will do it for free, considering its your phone bill anyways.
Good luck and God Bless...
