Yesterday was the hearing in NY.<P>Around 11 AM, the Hearing Officer called the house and asked for my husband. He got on the phone and was told that this would serve as the electronic testimony and he was under oath and was on the speaker phone. <P>The introductions were made of everyone in the chambers. The OW was there with her attorney which surprised us because she is a Welfare Queen of 35 living at home with Mommy and Daddy and we thought she was out of the picture and that the State of NY was simply following protocol.<P>She and her attorney were requesting that my husband be incarcerated for six months for nonpayment of child support.<P>My husband asked the Hearing Officer if he had received the Fed Ex box he had sent containing the documentation of his earnings, support payments made, bankruptcy papers, divorce papers, doctor's reports, medical reports, et al.<P>The Hearing Oficer said he had received the box and he was opening it as they speak. He read the cover letter and went through the hundred pages of documents and announced that he would need time to examine the documents and it was clear that payments had been made and the Plantiff's demands to have my husband incarcerated were denied and court would be rescheduled for March 16.<P>So, it was a victory of sorts. The attorney and OW sputtered their displeasure and my husband has been temporarily granted his freedom until 3/16/01. We are hoping that after the Hearing Oficer has had an opportunity to examine the documents that he will conclude that the payments must be reduced to a fair payment and the arrears be adjusted accordingly.<P>I have no idea how he will decide or how this wil play out, but for the time being the court is leaving us alone, they have all the documentation we own explaining our situation and the OW is really, really upset.<P>It's a beautiful thing.<P>Catnip =^^=<P>Leelee: I know you went to the Church and lit candles for me and prayed...it must have been a bonfire...thank you. It worked. <P>And to all that prayed for us, the power of prayer works miracles. Now if I could ask that you pray that the Hearing Officer considers all the evidence and grants a fair and reasonable support amount and the arrears adjusted accordingly, I would greatly, greatly appreciate it. Catnip,<P>I am so happy for you. Any small victory is a victory in this situation. Needless to say our side of the court doesn't get many. I too hope that they read and review with real justice. You like everyone here are always in my prayers. What a nice relief that had to be for you and your husband congratulations. To have the amount at least be what the law says would only help in your healing and moving on.<P>babstr.

oh catnip, i am so happy that that hearing officer postponed things until he can read through all your documents. i pray that he will use as much common sense as he did today, and lower your payments and retro it back to the arrearages. you have definitely had your share of bad court experiences, maybe this will be the start of some fairness from you. which i know is all you are asking for. may god bless the hearing officer with the wisdom and compassion to see your circumstances for what they are and order what is fair and just. take care catnip. we love you here, though you probably know that.<P>love, happy_girl

I am so glad Catnip! Things are definitely looking up. I believe the best thing is that she (OW) is so upset - as my older daughter would say "Nana Boo!" My dear friend Catnip,<P>What great news!! You have been in my thoughts and prayers. As you know, we are in a similar situation, but our attorney will not begin preparing our case for reduction of support, arrearage, etc. until next week, so it will probably be quite some time before anything changes.
