I am in the process fo trying to fill out the income and expense forms that we will need to submit to domestic relations on march 9th at my cs hearing against h. I'm also filling out his form for him. I desperately need suggestions as to how to list our expenses. It has to reflect that he is paying a portion of costs for his "apartment" without contributing to my household. My original thought was to have him paying 40 a week straight out because that's about what a straight set of rooms goes for per week here, then just deduct 160.00 per month from what I pay out in house payments. But then I thought that cs officials might count that 40 per week as additional income that I have, or as money that h is willingly contributing to the household. Then I thought that since there are 5 of us total, I could list him as paying 1/5 of all expenses as just his share, but I see problems with that too. I have said before that while this is our house, my aunt and uncle are the official owners. We can't work out anything with them as far as having them say h is renting part of house because they don't know anything about the oc situation. This is all very confusing. I especially have to make sure mine is filled out right because it has to be complete in order for me to get spousal support. Maybe we should just say he is paying nothing at all for that part of the house? Thoughts anyone? Catnip? Iknow our sit. is not the same as your because we're not divorced, but maybe you have ideas?<BR>Bystander, maybe you know what contitutes separate households and how expenses would have to be divided.

What about officially sub-letting that portion of the house to him? He would have to pay you his "rent" and you would be responsible for forwarding it to the proprietors.

I just noticed that it says to only show extraordinary expenses in the expense section. Does this mean I don't have to have h fill out his at all? I know that I still have to fill it out in order to get Spousal support - should I just list all the normal household expenses? Anyway, I know that h has never been asked to fill one out before this. I'm thinking that I might be better off just saying, if they ask, that he is not contributing to expenses any way at all. What do you think?

It didn't do me any good to try and structure it…we just "played it be ear". They ended up coming to my house. It was kind of late, and the weather wasn't too great. They didn't want to wait until the next day to see Jonas, and I didn't have the heart to insist. As for handing the baby to her first…I chickened out. As soon as they knocked on my door, I placed Jonas in the cradle I have downstairs for him. I figured that I would just point them in the baby's direction and let them decide who would do what. It really tore at my heart to see him holding my son. He wouldn't look me in the eye. As for his W, she was really nice. We both took a stance with her H and let him be fully responsible for the baby while they were in my home that evening. Part of me wanted to run to my son's rescue, but the wicked part of me was thoroughly enjoying his look of utter confusion and panic. My little guy had this 6"3", 220 lb. man in fear. He had absolutely no clue on what to do with him or for him. When his wife wouldn't help him, he looked to me and I told him "No way. He's your son, so get used to it." His wife kind of chuckled said "That's right." As if on cue, Jonas spit up on him. I guess dad forgot to burp him. His wife and I were rolling with laughter. I don't think he saw the humor in it.<P>Catnip, this is for you: I wore sweats, minimal make-up, and kept my hair pulled back. It didn't help that I was babysitting my sick 1 year old nephew, who kept insisting on using me as his human kleenex. I figured the snotty shoulder would help get the desired effect.<P>

cd: <P>When we did our financial statement for the courts, we cut everything right down the middle, including the mortgage payment. We did discuss beforehand that if we were forced to set up separate households within our house, we would split everything down the middle as well. We have no children at home, it is just the two of us, but with you having the kids, all in your custody according to the agreement, I would be inclined to go along with Ohbratti and consider the sub-lease arrangement. <P>I am not well-versed in rents or leases so I will bow to Ohbratti or someone with knowledge in this area. Regardless how you structure this, it is a heck of a smart way to handle this support issue and I am so glad you are going to the steps necessary to protect yourself and your kids from unrealistic and unjust income shares extortion.<P>Ohbratti...I bet you looked lovely and genuine. The only reason I cautioned you about being too doo'd is because the Wife could have construed it as interest in MM and been threatened. I just wanted it to go well for you and for the Wife to feel comfortable ultimately for Jonas' sake.<P>Hahahaha...I am happy to hear you and Wife enjoyed MM's discomfort. Kind of a bonding thing, right? <P>How did she seem around the baby? What did you 'sense' about her? Were you comfortable around her?
