My h took off from work today to drive to the county that cs was filed in to petition for modification (2 hours away from our house). The case worker said that she doesn't understand why their county is still involved - neither ow nor my h live in that county anymore - so she asked h where she should transfer the case to. he told her to send it to our county. So caseworker is sending all files to our county, including the modification papers, so we will have that hearing here. From now on our county will have jurisdiction over the cs matter. This means that if ow wants to come and argue with the modification, she will have to come all the way up here - over a three hour drive from where she lives. Wait til she finds that out!
Also, our lawyer is pleased because he said the judge in our county is far easier to deal with on these issues than the judge in the previous county would be. Lawyer is very happy that all of the cs proceedings will now be on his "home turf", plus it will save us money on his fees because he won't have to travel that far to represent us.
Now all we have to do is wait until they send my h the court date, which may take a couple of days because of the transfer, but it is still going to be retroactive to today.
As far as the mediation goes, our lawyer is finding out for us exactly how they set things up in her county. Then he will let us know what to expect.
Please keep up the prayers - they are definitely working!
With love,
-cd

cd:
I'm so pleased things are falling into place for you. It's been a bumpy road but at least now you are gaining some measure of control through all your proactive actions. This must be such a relief for you and your husband.
As always, you're in my prayers.
Catnip =^^=

Well I am really glad that the paper work is getting transfered. That will make it a great deal easier on you both , as you said. As for the mediation we just went thru that as I told you. A month or so ago. It really was not so bad, at least in our county and state. I mentioned to you on a earlier post, I had a feeling the oW would pull something as she did. I do think you are going to get better results skipping that meeting with the lawyers and having the mediation with a professional trained in social services. This is how it worked best for us. The mediator explained to the mother that it is the H legal right to have visitation and made it clear that she was going to have to work with all involved to agree on something. I think my lawyer mentioned to the lawyer of the ow that if she continued to refuse to work with all involved he was going to sue her for his legal fees. This is when she started being more agreeable. Well good luck you are in my thoughts and prayers. Keep us posted. any ? just let me know. H has his third and final supervised visit tomorrow, and then they become unsupervised. Take care. GABI 1116
