cd,<BR>Why would it cost you a $1000 now to file for emergency custody? I would think as the biological dad he would have first dibs at immediate emergency custody?

Hi silouette,<BR>It would cost $1000 because our lawyer would have to drop everything else he is doing to give us primary attention. If we had had frequent contact with oc before this, C&Y would have handed us oc without a question. But since we have not been able to see oc in over a year, they thought it would be best if oc went to ow's mother.<P>It is EXTREMELY frustrating to sit back and do nothing when we could be making some progress with this, but we just don't have the money. I understand where our lawyer is coming from - he's already been very patient about us paying his fee in intallments, and I can't blame him for wanting money up front for something like this.<P>It just ticks me off that my h can't even go comfort his daughter after such a horrendous act. But that's the way it is, until we get a court order, there is nothing we can do about it.<BR>-cd

I am no expert in this area but I would think you could go y ourself to the courthouse, ask the clerk what paperwork you would use, and file for immediate emergency custody. I just think that it may not look good if you didn't go for immediate custody, and I wouldn't want that to jeapardize your chances. I would also be vigilant with Social Services, that your husband is the biological father, wants custody and was in the process of pursuing custody when this occured. I don't know all the circumstances regarding this OC and why your husband hasn't had visitation but I think that you ought to insist upon custody now. The father needs to be able to comfort his child.

I did a custody claim for my niece & it was only a $25.00 filing fee and a trip to Junvenile Court. I think I would try it CD. No lawyer would have to be involved. Or he could join the fight later if necessary. Carolyn
