I am just curious as to how much people have to pay for cs in the USA, ( I am inCanada) Ours is actually quite minimal (we are not paying) It is not retroactive to the childs birth only to the day of filing for support, is it very different in the USA?,

Yes, my H pays CS for OC. And it is retroactive to the child's birth, which came to $20,000. She waited to file until the child was almost 3, and at court hearing she was 42 months old, so they did got the back support that way. Since my H's weekly pay varies, they took the average weekly from his YTD earnings. He makes from $1600-2400 per month before taxes, and the CS amount is $450, the back support amount we pay per month is $177. That is at 10% interest, so we will take forever to pay that off.
happy_girl

$1,500 a month (since birth) and she is trying now to get more benefits (life insurance, college tuition, etc.). It is terrible. 20% of net income is mandated by court.

takingcare,
WOW! looks like OW picked a man she knew made some good money. why should a child need $1500 per month. some families live on that. completely ridiculous. i barely make that per month. another example of why CS laws need to change.
happy_girl

Fizzpop,
We are with you in that minimumal cs. None. Her choice.
But I have checked on the stats in ow's state and in our's to see what we are looking at if this ever blows up in our face. She is in Arizona and we are in Texas. Tx goes by the net income (after taxes) and it is a percentage. We would pay @360. That is not taking into account medical or anything else. That would possibly lower it. Arizona, on the other hand, goes by gross income and they use what I think they call a shares model. They even considered other cs and the fact that we have one and it is still more. 200$ more than Texas, as a matter of fact. As far as back cs goes...I dont know. We have kinda an interesting situation. Ow had filed for cs in Az and turned around and dropped her own case. Our lawyer had no idea what would happen if she came back and sued later. He said no one in Az had done that so if she did it we would (i guess) be making law. That is what he said. Hope he was not just being lazy.
Love
bw
[This message has been edited by broken_wings (edited May 12, 2001).]
[This message has been edited by broken_wings (edited May 12, 2001).]

Fizzpop:
Cute name.
OW is from NY, she conceived in Texas and we live in Minnesota.
NY wants 17% of gross, Minnesota wants 25% of net and the courts in NY have garnished 70% of gross because of their original judgment from an arbitrary number plucked out of thin air with nothing to back it up. Scary how these family courts are so autonomous that they can call shots, change your life forever without any representation.
We just moved three hours north of our home city...but, we are now just a couple hours from Canada...sounds like we should pack up and continue further north and begin singing "O Canada" with gusto.
Catnip =^^=

Yes Gregg & HappyGirl... unreal isn't it. At one point a few years ago my H didn't bring home that much. If the CS was based on shared cost of raising child then I don't think I would be as bitter. And I really am bitter. My in-laws live on fixed income & struggle each month. That money could have gone a long way to assist them. Or college for my kids. Anything would be better than this situation.
Carolyn

My daughter knows she has a"father" that isn't in her life but she knows she has a "daddy" that is and loves her. she will seek her "father" out and he will be the one who has to answer to her. i do feel that some child support amounts are rediculous, $1700 for one child that is crazy! Yes i was in a committed relationship and it wasn't an affair but i am one who believes that idf you create a child than you help pay for that child.

Boy, those are some painfully large amounts, ladies! Ours is over 500, but relative to our smaller income, i'm sure.
I do believe men should pay child support (you PLAY you PAY--our Hs were idiots), but I'd like to see given (half) what a child Actually needs, or a more consistant(nationwide), more fair basis. I am SHOCKED at some states' guidelines, for instance 25% of man's income in CA PLUS extras, or the fact that in Alabama the man has to pay the woman's lawyer's fees when she sues him for more ch-support--it's just insane!!

Hey guys,
Another thing to think about. I found out the hard way that creditors don't give a flyin' **** about divorce decrees. If your name is on the bottom line, you are liable. Just last year I finished paying of a central air system in a house my ex wife sold eight years ago.
God bless you,
------------------
Gregg

Gregg--omgosh
It seems our country is always going overboard in way or another... we went from too few rights for women to sticking it to the men big time... the scales of justice ought to be more blanced.
I have friends who like you spent YEARS paying off the ex-wife's debts, meanwhile she married the guy she'd had an afffair with and lived high on the hog. YUCK.

H has to pay $525 a month. The first payment is due tomorrow and we don't have it to pay. Now he has lost all his overtime hours and starting next month they will take it out of his pay check. It's almost a whole check. He's paying cs and 64% of daycare (that is twice as much as we pay for our child that is 7 months). We are trying to contest it.
