Hi <BR>I just found out that H had A and the OW is pregnant 5 mos along. I was home while H was out of town and process server delievered the not so happy news. A friend recommended I come here for information and support. <P>The OW is out on disability due to pregnancy complications and wants H to start paying medical and other support???? Is this legal? The baby hasnt even been proven to be his. He says he knows it is since he was with her for three days and her due date coordindates exactly with this time. But I want to make her work for this..Do you think a court will make us start paying now?? This seems outrageous to me!! Thanks for any advice..

I'm sorry you're in this sad boat, but welcome to the board! First find out what your state's laws are--each state is different. Does XOW have insurance through her work? She shouldn't get benefits twice. I'd recommend a lawyer too. Sometimes you can get an initial consultation for free; my H did. Your H should not pay XOW anything until DNA is done--period, but in some states if DNA is positive the man is liable for some of the past medical expenses... which is why you want to check and see if he needs to start setting money aside.<P>We'll be here!<BR>(see my post for newbies)<BR>J, in recovery 3 years<p>[This message has been edited by Jenny (edited August 06, 2001).]

Thanks for replying Jenny. I am sure she must have some type of insurance, she works for an airline. I am not sure we can afford a lawyer but maybe we can get the free consultation. Do we get the paternity test before the baby is born? Or do we have to suffer the unknown until December? My H is just content to let it all happen, I want to be proactive and come out of the gate fighting. I am so mad right now....

A DNA test before the baby is born is an invasive procedure that carries a weight of a miscarriage so it is VERY unlikely the ow would have it done while pregant, there are some companies that you can get dna results faster then others once the baby is born. The best advice is to look up your states cs guidelines and guestamate what you will have to pay every week/month and start saving now. Sorry to invite you to this group.

whatif is right blueeyes--you'll probably wait until birth+ for DNA. Also, I should say the ch-support goes by the state the XOW/OC lives in... if she lives in a different state, go by her state's guidelines, not yours. You should be able to find state guidelines on the internet; some even have calculators to help you figure the amount. Again, you shouldn't pay until DNA and maybe even court, but H could be liable for past expenses depending on the state.<P>My anger ideas are in the post for newbies.<BR>Prayers,<BR>J
