My son recently broke up with a gril he has been living with for 2 years.<BR>They have a 1 year old son. Because her divorce was not final when the baby was born her H's name is on the birth certificate.<BR>My son went to local cs office and told them he wanted to set up cs payments and because I insisted a paternity test.<BR>Guess what ??!!!! They told him NO. That he could not ask for a paternity test and could not pay any cs until she asked for it. And at that time he would be responsible for any back payments.<BR>I swear I just don't understand these people. Here they have a man that WANTS to make payments and they won't let him but they are kicking mine and H's a$$ every chance they get !!!!!!!!!!!!!!!<BR>Someone please explain.<P>Jtigger <BR>

You have got to be kidding!!! I guess if he cant do it any other way he should set up an account and put what he would pay in cs in the account each month. Then, God forbid, he ends up with back cs, he will have it. Unbelievable!!

I have no comment I'm too shocked! These people are crazy and the sad part is that in most states they can get up to 3 years back CS.

You know I have been on a tangent lately when it comes to the system....but you know what I would suggest? Take it to court. The only way the laws get changed is whe someone challenges them. I would start looking for a lawyer who is wanting to make a name for himself. And I would bet someone would take the case. It might take some searching, but I would bet someone would. If you decide to look into it I would love to know what they think.<BR>Love<BR>bw

Hi Jtigger,<P>When I first found out about oc I called around trying<BR>to get dna test done. I was told my H has no rights.<BR>Only the mother can bring about paternity suit.<BR>Alleged fathers have very little ground to stand on.<P>How unfortunate for your son. He is trying to do the<BR>right thing and the law is not on his side.<P>Best of luck for your family!

is there any way for your son to get this in writing. if they are so sure of the law--i don't see why they would not give this to him in writing. when my OW missed her scheduled paternity testing appt. i had them send me a letter in writing stating she agreed to take test and then didn't show up. therefore, if and when she decides she wants to take my dh to court--i have this letter. i hope all works out for your son.
