OK Bonniebb. Your so da*n wise, and are so convinced the court is ONLY interested in what is best for the OC explain this one. My son has an illegitimate child by an xgf. While they were living together she was seperated but not divorced from her H. 2 Months ago my son and she split up. He went down to the cs office to arrange a paternity test to have his name listed as the baby's father because since she was still married her H's name was on the birth certificate. He also wanted to arrange cs payments. He was told tough sh*t. He had no rights to request a paternity test and he could not request to set up cs paymenst. However, if 10 years from now she decided to persue it he would be responsible for payments back until the time they split up. Now if the court is SO fuc*ing interested in what is best for the child why won't they get the ball rolling on cs even if the mother doesn't want to cooperate ?? After all , according to you, that is what they are there for, to see to the best interest of the child.<p>Jt

Simple....you are not telling us all the facts. There is more going on here then you are disclosing. He does have rights. Now you are also saying he was sleeping with a married woman? He will obviously need a lawyer since his name is not on the birth certificate.

No no no bonnie. There are no more facts to tell. Not only was he sleeping with a married woman he was living with her for over a year. Although she and her H were legally seperated. He has no rights, period. And that child has no rights unless his mother says he does.
