We finally got the overpayment in child support back $600.00 and it is finally on paper that h has no more back support owed.
Although they have had this money since Sept.YE HA! SLUT Payments are paid up to date.<p>

And I couldn't be happier. I hope with all my heart you and your husband can pull this off in spades.<p>So, tell me, what is an "injured spouse" form? And where do I get one? And what does it do for you?<p>Having everything in your name is the smartest thing in the world to do...this is what I have done as well and I feel so much more secure. In Minnesota and in NY, family court cannot take the spouses money or income into consideration, so we are protected there-somewhat.<p>Hahaha...I'd love to see your spouse all trussed up in an apron. Pretty funny, but oh so worth the humiliation. How much is he obliged to pay if he is a house husband with no income?<p>You're one smart cookie.<p>Catnip =^^=

Flowerseed,<p>I'm glad all worked out for you. I have a question for you why do you have to pay H CS if he's unemployed? Won't they lower the support amount? Just wondering.<p>Catnip,<p>An injured spouse form protects us if our H's owe back C.S. when you file jointly to the IRS. They will refund your portion of the return. You and H have a faux divorce so this won't help you.<p>Unsure

I know the state can't touch your money, but I was just wondering if the state can require that your H get a job so he can pay CS? Do you know? Someone told me that I am not sure if it is true or not.<p>Dawn

Dawn,<p>The court cannot oblige H to get a job, but they can base the child support amount on his potential earnings....even if unemployed.

FS,<p>I'm a control freak also. I sent H CS payments before they garnished his check. Like you I keep calling and even though they say they can't give me information they do. My state also has a website and email address. So now I send emails in my H name and get all the information I want. [img]images/icons/wink.gif" border="0[/img] (Look up your state it's really convient I get all my questions answered without the hassle)<p>I was trying to ask the same question Dawn asked would they still require H to pay CS if he couldn't find a job? I think Ohbratti1 answered the question. <p>Good luck! It does feel good to be in control I feel that way again in our relationship. exOW can only do what the law allows her to do our lawyer is making sure she realizes that.<p>

Dawn, Obratti is right they would base it on his potential. He never even asked for them to lower it when he became
unemployed we pay the money and want to be left alone. We can paint a pretty ugly picture is it necessary in that department
as far as h potential . We realize there is no way this will be over until this kid turns 18 we just want to be left alone. The thing is
my h has never missed a payment since it was ordered. The back support was from when she filed and till an order for support
was entered. The foc just seems so worried about making sure they do there job they over do it .These people treat him like he
has never paid a dime. I think I hate them as much as I do the o.w. We are going to have the biggest party this world has ever
seen when this is over and your all invited 151/2 yr. to go.<p>Gem and Catnip, thanks things are going best its ever been. Business is doing great it sure makes life easier when you have money. I think I
