Does anybody know if my income can be taken into consideration in determining CS? I live in Oklahoma. xOW is trying to get me to turn over my fiancial information to her lawyer. We would have to pay a hefty amount if my income were considered. I make a lot more than he does. In the temporary orders he has to pay $300/month in CS, $200/month daycare, and 56% of unreinbursed medical expenses. He is entitled to 100 days/nights per year visitation and has joint legal custody. They have had that written custody agreement for the last 2 years.<p>The xOW is very greedy. We use to give her $2000/month in CS but I decided that I did not want to help support their child anymore. When my husband lowered the CS to $400 she took him to court to get CS legally established. I am now expecting a child of my own and my money will be directed toward my child now. The OC can have the benefit of my money when she comes for visitation. I will go to a lawyer if I have to. I just hate to waste money if I can do it myself. Thank you!!<p>Arisa

Arisa,<p>I'm in Oklahoma too and no, your income is not a factor. However, you should also be aware that any children you have with your H are not considered either. So the CS will be determined based only on the incomes of both him and the OW.<p>We did a private agreement to help protect the interests of our four children. Thankfully our OW was agreeable to that and it worked out for all of us.<p>I'm going to try to post a link where you can put in all the figures yourself and it will tell you what the $$ amount will be. I think it will probably be higher than what you are paying now because the CS is considered separate from child care.<p>This isn't the site I used, but it should work the same. I just wanted to give you an update. The judge refused to order that I turn over any fiancial info. All I had to do is take a black marker and rub out my info on the tax papers. This is a big relief to me. The xOW wanted to settle out of court for the $400/month my H had agreed to pay originally but he turned her down. Because she took him to court she will now be getting $100 less a month. [img]images/icons/grin.gif" border="0[/img] [img]images/icons/grin.gif" border="0[/img] <p>She was MAD but I don't care. She can no longer try and control us. Everything is in writing now and court ordered. Now we can fully concentrate on the baby we are expecting.
