How I hate to burst any bubbles here, but why wouldn't her mother provide her with receipts (even if they're fake).

I know that at one time I needed childcare receipts for tax purposes. I had misplaced or just didn't get them. I didn't realize that i'd need them. My babysitter had become a friend so she went out, bought a receipt book and wrote me as many receipts as I needed. She just back dated them to be (or at least appear) legit.

I think it's great if you get ALL of the money back. Espically if she's lying about how much she's spending. I would just be cautious about celebrating too soon. If she lied so easily about the cost, i'm sure the wheels in her brain are turning about how to get receipts and save her [censored].

Anyone that provides receipts for providing childcare must also show via their income tax forms that the money was declared as additonal income on their yearend tax return. If they did not claim this additional income, they are guilty of tax evasion. Not too many people are foolish enough to provide someone with fraudulent childcare receipts, risk an IRS audit and possible prosecution. And if I had reason to believe fake childcare receipts had been created, you can bet I'd also check into the tax returns of the provider to make sure that income actually was declared.

That makes since. Do the courts do that thorough a check as well?

I remember having to submit childcare receipts during our support case. I simply provided photocopies of receipts. It was never questioned.

Then again I never really pushed for CS (thank god I didn't really need it).

If this woman lied I think that she should pay back double every cent she took. I'd just advise being cautiously optimistic about how much to expect back.

In my state there if no benefit in claiming more than $2500 in childcare expenses. So every year I just claim that amount despite the fact that I pay FAR more than that. That way my baby sitter makes some tax free dollars. In return I don't pay late fees or overtime charges.

Correct answer. Our lawyer let ow know right off the bat that he would not hesitate to subpoena old grandma's tax records. OW didn't want grandma to go to jail for tax evasion.

Haven't posted lately but had to say HOT DAMN!!!!
After all the "justice" we have been dealt it is soooooo utterly refreshing to see someone's exow who has been dishonest, get busted AND be held responsible. Most of us have been responsible since d-day, but rarely have I seen an exow step up to the plate. And some ask "What is this world coming to..." Maybe the tables are starting to turn. CONGRATULATIONS!!!!!

It just keeps getting better !
Xow called our lawyer's office today. She wanted to make sure we knew that the cs case manager told her to get the affadavit ( sp ) for the day care cost even though she knew ow wasn't paying any just in case she ever needed it.
So now, the cs supervisor will be getting a call from a VERY pissed off lawyer tomorrow demanding an investigation into why her employyes are telling clients to commit fraud.
