Hi all. I know CS is often a very popular topic here. Just thought I'd share that I have been helping MM w/ some legal issues in regards to his son - 11 by a woman he never married. He has always paid CS. When we got together I also calculated what CS he should give the W according to the Ga guidelines. The interesting thing was it worked out great because although his son had the first order for CS he was making a lot less money back then. Thus the 22% they were taking out ended up being approx 1/2 of what he would be expected to pay for 2 in Ga (23% - 28%) with his current salary.

Anyway we have a Contempt hearing coming up soon and I contacted the agency handling his CS to get a pay history to offer as evidence in Court. I also mentioned that according to my calculations he should be paying an extra $14.00 bi-weekly and we wanted to voluntarily raise the CS.

The case worker asked what guidelines I was going by and I stated the Georgis 28% (THE HIGHST PERCENTAGE POINT FOR 2 KIDS). I explained that he and his XW also had a child and how much we were paying for CS.

The case worker informed me then that their agency uses a standard 25.5 % figure for 2 children. She also stated she would send me a packet to fill out (we did on the 16). She also requested that we send a copy of his daughter's BC. It seems since he had another child (even though it was born while he was married) this CS agency automatically takes the 25.5% figure and cuts it in half - even if he is not paying CS for the other child born.

We called her today and the CS will actually increase only by $5.00 bi-weekly. She also stated that the amount he pays in health insurance is deemed unreasonable by their office and that he would not have to continue to carry the coverage. However, we will keep the insurance.

So it seems atleast w/ this CS agency in Georgia they DO treat all children equally regardless of their individual circumstances. tew
