Because I've never been in this situation before, my question is:

Is it possible to determine who the father is prior to birth?

Should the mother need an amniocentsis (sp) it is possible to have a DNA test done at that time. (emphasis on NEED... Doctors will not perform an amnio solely for a DNA test)

But, in order for it to be recognized by the court system, I believe a swab of the child's mouth must be performed after the child is born.

As Stacia mentioned, it is possible by amnio. It's unlikely that a doctor would perform amnio just for this intention. And as far as any "legal" issues regarding the child---that can't happen until the child is a "person"---which is currently after birth.

there are also blood tests that can be done. my husband and I just found this out thru research as we are in a spot and needed to know. let me know if you need assistant on locating company that has the testing info/kit.

How long after the OC is born can to OC be checked for DNA? Is it right after birth or a few months down the road?

DC,
The DNA test for Lil Bit's paternity was performed when she was 2 wks old.

It was a swab of the inside of the cheek. They swab the child's mouth, the mother's and the alleged father.

The results came to us within a month.

As far as fetal blood tests, I am not aware of any. Amnio tests I have heard of, but not blood.

Depending on the state that you live in, the amino will hold up in court. It has legal documentation. It's double the cost than if the child is already born. Also, I was told by a popular lab they can do the swab the day the baby is born. If it's done through blood they have to wait awhile. It can also be done through cvs which can be done even eariler than amino. Again, most reputalbe doctors will NOT do it unless it's medicaly necessary. Only makes since seeing there is a chance with both procedures.
