I am trying to have our house put in my name only. I've had H sign a letter saying that was our wishes because I am the one finacially responisible. The bank has now sent me a letter asking for more information. One of the things they want is a quitclaim deed.

Do any of you know how I go about doing this? Is a lawyer necessary? I was told to contact the local registry of deeds. I am looking at a copy we have with both our names and it only seems to be witnessed by a notary public.

Is there anything else I need to know?

I appreciate any feedback.

In 1996, my discovery, I filed for divorce. In order for me to trust h again, or not, we got a quick claim deed that put the house in my name only. We also put all stocks, bonds, bank accounts, etc., in my name only. This was all in 30 days. We are still in recovery, married 31 years. I am glad I am still married to my H.

This gave me financial security, and peace of mind.

Do you have enough income to get the mortgage in your own name?

There are two issues to address when getting a house in your own name.

1 - Ownership. A Quitclaim Deed is signed by one person to end all claims to ownership of the house. The other gets sole ownership.

2 - The mortgage. They gave a loan to whoever is on the mortgage. Whoever is on the mortgage owes the payments until it is paid off or refinanced. A quitcalim will allow you to refinance in your name only.

Even if the court awards the house to one party, the other will still owe the mortgage until it is paid off/refinanced.

I didn't know it was one word. I do know it made a difference in my world at that time. In my case, there was no mortgage. House was paid for. You are correct, a mortgage is a different consideration.
