The OW and the state (I live in WI) are going after OW's H for CS of her 2 kids and of OC. How can this be? She is still legally married to her husband but she put my H's name on the birth certificate. Will the state order a DNA test of both men? Or is OW's H assumed to be the father because of the marriage? I'm really confused and need some help.

I am assuming that you mean YOUR husband is on the BC. If that is the case, then no, she can't make a man pay for anothers child. If her husbands name is on the BC. She can. He would have to counter with a DNA test and go from there.

If this child is your husbands, and DNA has been established then the husband can fight that request. I am sure, if he knows that child is not his, he will fight the child support on it.

How can she even list OC as her husband's when another man's name is on the birth certificate and how could she go after her husband for support? Wouldn't a DNA test need to be done on "both" men? WS is in jail and wiil be for quite some time.

Hi Cyn,

I think she is desparate. OW realizes now that she screwed up. She cannot collect from your husband for a while so she is going after her husband. She is just selfish. All she cares about is the money. Give her a little time. Maybe she will hang herself with her greed.

In some states, the husband is legally considered the father of any children born of the marriage. We had a case in my state where the dad was trying to get visitation to his child, and it was denied even though he proved biological paternity.

Cyn in most states when married the husband is automaticly considered the father of the child and resonsible. If her husband is smart he will contest this and order a DNA test. Depending on the laws he could not have to pay cs. I personally think that is mean that she is doing this to this man who is not the father.
