I was reading my news, this man is able to sue his x-lover for making him a father against his will..

Man can sue woman he says made him a father against his will
Email to a Friend Printer Friendly Version

Stations: Note contents of following item CHICAGO (AP) _ A Chicago doctor has won the right to sue his former lover because he claims she caused him distress by making him a father against his will.

Doctor Richard Phillips claims Sharon Irons stole his sperm and used it to impregnate herself six years ago.

Phillips' lawsuit contends that he and Irons never had intercourse but did have oral sex three times. He says Irons, without his knowledge, kept some of his semen and used it to impregnate herself.

A Cook County judge dismissed Phillips' lawsuit in 2003. But yesterday an appeals court panel reinstated part of it and sent the case back to the lower court.

But the appeals panel did affirm the lower court's decision to dismiss fraud and theft claims against Irons. They agreed with Irons' lawyers that she didn't steal the sperm.

From Rules, Policies, and Disclaimers
You agree not to post any copyrighted material unless the copyright is owned by you or by this BB.

I was hinting that you should at least remove the "Copyright 2005 Associated Press. All rights reserved. This material may not be published, broadcast, rewritten, or redistributed." from your post.
After all, you are breaking the law and very well flaunting it.

Okay this one is a bit wacky BUT.......the courts ruled his sperm was a GIFT & he had no right to want it back? hahahahahahahahah

So even 'safe sex' <img border="0" title="" alt="[Roll Eyes]" src="images/icons/rolleyes.gif" /> does NOT mean you are safe from YEARS of CS!

I guess when they are teaching highschool kids that it is OK to engage in oral to prevent pg-----they better also inform & educate young men the consequences of a pg that results in a positive DNA match due to ANY exchange of boduly fluid hanh?

And how could the courts NOT find her use of the sperm UNreasonable. Like ANY person would expect oral sex to lead to pg?

Wow...I guess I'm not as crazy as I thought I was. I remember entertaining this idea last year when the OW claimed to be pregnant by my husband even though most of time they had oral sex. I kept wondering if she had "saved" it for later.

Ok...back to reality, I guess.

Many people benefit from these forums and it would be nice to keep them from getting shut down because of legal troubles Marriage Builders, Inc. may encounter because of simple rules being blatantly disregarded. <img border="0" alt="[Teary]" title="" src="graemlins/teary.gif" />

Chris,

This is not against the law.

Now, if Crazymum was SELLING the info, there would be a problem. If she was making ANY profit from posting this article, there would be a problem. This is information on the internet being used for educational purposes. Nothing illegal about it.

She is in the right by posting the Copyright information. If someone DOES want to use this article for something other than (nonprofit) education, they would need to obtain permission from the author.

Not flog a dead horse but (i was finished)... <img border="0" title="" alt="[Roll Eyes]" src="images/icons/rolleyes.gif" />

Make a simple statement and everyone gets all bent out of shape.

CheerfulLittleOne:
This is not against the law.
Maybe, maybe not. But it IS definitely against MB Terms of Service (See above), which we all agreed to when registering.

Now, if Crazymum was SELLING the info, there would be a problem. If she was making ANY profit from posting this article, there would be a problem. This is information on the internet being used for educational purposes. Nothing illegal about it.
Perhaps. But the "Fair Use" portion of the Copyright Act is not explicit and is open to interpretation. (which is probably why Steve does not allow posting of copyrighted material).
Also, it's very, very doubtful that posting the article on this site could be considered "educational" use under the copyright act.

If she had simply left "Copyright 2005 Associated Press. All rights reserved", I wouldn't have even replied, but she included "This material may not be published, broadcast, rewritten, or redistributed."
Then she immediately redistributes it. <img border="0" title="" alt="[Roll Eyes]" src="images/icons/rolleyes.gif" />

And again, MB TOS prohibits posting of copyrighted material. <img border="0" title="" alt="[Frown]" src="images/icons/frown.gif" />

Chris, noone is upset. (as far as I know)

I appreciate you doing your public service announcement to remind us of the rules. I know you were only trying to be helpful. (right?)

It's all good.
