Regardless of whether or not it's legal, you're going to do what you're going to do. You appear to be having a moral dilemma with it and are looking for validation.
Is it justifiable to look through someone else's personal property? What are you going to do if you find something that you don't like? Even if you don't mention it, it will drive you crazy. Sometimes it's better to not know, and I speak from experience. Things, taken out of context, are not always what they appear to be.
Besides, if she catches you, wouldn't it do more harm than good as you are sneaking around behind her back and snooping through her personal belongings? Don't you want her to know that you love her and TRUST her?
Just a thought.

Hi Rick,
Are you going to install it on your home computer? If so, you're okay. Just as if you have an answering machine and the other man left a message that you listened to.
It would not be a good idea to install it on a computer that you don't own, like a business laptop, etc. There could definitely be legal repurcussions there, but there could also be to installing a game program on a business computer.
I certainly know people who have done this on their personal computers and have found out their spouses were cheating. But don't you already know that? If you are sure she is having an affair, what will you do with the evidence? How much will it hurt to read their private conversations?
I am not encouraging you in either way, just think it through carefully before you decide to do it. I personally wouldn't worry about the legalities at all, but the personal consequences could be devastating.
Peppermint

If I had been more suspicious and more snoopersmart, my WS wouldn't have been knived by the chinless banshee.(the good part is that chinless wonder landed in jail. I snooped after the A was exposed and found to my horror - the length of the A, the costs, the hotel receipts, etc.. I then demanded and got monetary compensation (for a Private Detective Fund for life and wherever he goes, there might be a private eye) and holidays, etc.. WS became less able to conceal stuff.
If the marriage is buried in deceit, one has to do the digging.
