W who insists she only has friendship with OM got furious with me yesterday because I haven't got an apartment yet. She said a hotel is not her idea of moving out. She said it would be at least until summer before she would consider me moving back, if at all. I suspect this is a strategy to ensure that she get custody of the kids. Does anyone know if I get an apartment instead of a hotel, will I lose any chance of custody? I want to make things work, but do not want to be a pawn in her little game. I am going to call my attorney today. Just curious if anyone else has any information.<P>Actually, I am considering moving back and kicking her out. The problem is she says she won't leave the kids. She told me she would take them. Can she a restraining order or something keeping me from moving back? Can I get a restraining order against her taking the kids?<BR>

S&C - DO NOT MOVE OUT!!!!!!!!!!!!!!!!!!!!! Where would she take the kids? How old are they? Tell her YOU will not leave the kids. This is what I told my wife - I'm not going, I will not leave my son, and if you want to go, then go. She went and we arranged 50/50 custody.<P>Yes, see your lawyer - fast. <P>WAT

Sad and Confused -<P>I agree with WAT - don't move out, move back in. If she sees no problem with her relationship with the OM - then let her be the one to move out. She is the one that is being disrespectful to you and to your marriage - and to your family. You don't want to end the marriage, but it seems as if she does - so let her be the one to move out. I would consult a lawyer, too.

First of all let me tell you that I have been in a hotel for the past 5 nights. I have talked to my attorney, who told me I have every right to be in the house right now. My attorney also said it sounds like she's getting everything lined up by making me take permanent residence. <P>I still love my wife dearly, but I am done playing by her rules. She was the one in the wrong. She is the one that is keeping the contact with OM, but saying he's only a friend. I have no proof that she is wrong, but I'm working on that as well.<P>I fully expect that when I tell her tonight that see will have to leave if she wants the separation that she will file on Monday.
