Hi guys ...<P>About 2 weeks ago my H emailed me informing he has purchased a used vehicle and added it to our insurance. He has kept his old vehicle (very old) as well We are D as of June 13th, but our insurance was paid thru October of this year. <P>Okay ... so then I get an email from H asking about a week ago asking me if I have the title to the old vehicle, I don't and responded as such.<P>Now I just had a convo with OC #1's grandmother (I see OC all the time, he's my baby and we love each other)and Grandmother tells me that my H has said he is allowing OW #2 (woman who my H left me for) to drive the vehicle. I'm amazed at this statement because OW #2 is supposed to be very sick (ha ha) and not able to drive. She had silicone implants and they leaked years back. So she's SUPPOSED to have all sorts of weird illnesses. Also, OW #2 does not have a license to drive.<P>So, here's my question. Am I liable for OW driving that car? I mean I know we're D but my H and I share insurance thru October of this year. <P>What do I do, if I cancel our joint insurance it will cost my H $$ and in his eyes that's an LB. And then there's the evil/taker part of me that wants to tell the Insurance Co. that my H is having an unlicensed driver who is not covered drive the vehicle. <P>What should I do? Is OW #2 living with your H? I always thought you were covered as long as the person driving was not living in your household.<P>My mom says she is sure about the above statement.<P>You should really check with your insurance... You'd have to do it kinda sneaky though. Perhaps just call up and say you were curious, your son lets his girlfriend drive his car occassionally and you were wondering if he was covered since she doesn't live in his household.

No, they do not live together, officially that is. She is on welfare, so living together is not a good financial option for either of them<P>Forgot one important point .. my H only has "liability" on both vehicles. So, HBH, would she still be covered?<P>Jo

Yanno STL, I did a pretty damn good Plan A, didn't LB to much before and aft seperation. And now I'm in Plan B. I want to be remembered as the good guy. But I still am very concerned at the legality of this, and talking to my H about it is NOT an option.<P>Still thinking and waiting for more replies.<P>Thank you STL .. you always give sound, caring advice. You're covered for liability on that person, but nothing else (no fire/theft).<P>Definately call your insurance though and double-check, all insurances are different, you may have some special clause or something I don't know about. Did you like my idea? I think you can get all the info you need if you use that story.

Res,<P>Drop H's vehicle, change the insurance to a single policy. H can get his own. <P>When our insurance policy came up, they did their normal checkup call and asked about H's residence and mileage. I told the insurance co that H did not live with us and that he was 20 miles further than before to work. That would have raised his rates a bit. I was also in the process of removing him form our joint policy. We have a multi vehicle policy so he would have been the one to pay big time. <P>Hm..... well as you guessed he came home. Mumbled something about doing the D paperwork was to hard, insurance would be more expensive and other mumbo jumbo. What OW wasn't worth that extra effort? Oh.....what does that say?!?!? I love it, Maybe you can somehow let OW know that thats the reason he came home.... nah, she would proabaly offer to make up the difference. Even if the liability covers the vehicle, if she is unlicensed, the insurance company could very well cancel. Rule 1 when dealing with insurance companies: They don't give a rat's a$$ about you.<P>I think you'd be smart to sever this lingering link pronto.<P>If you're still plan B'ing, I think it's entirely consistent to disolve this joint policy. Resilient...<P>You can cancel the insurance and the insurance company will rebate you the difference of what is left that you have prepaid already. Then XH can get his own policy and add (Uggh) OW#2 to that policy, precluding you from ANY liability. I agree with STL, it is about protecting YOU. XH is using a little loophole to keep you attached and still get what he needs/wants out of you. Plan B would include severing his ability to do so, and since you are divorced, using your name/insurance is not part of the game. My understanding is of liability is that if OW, on your insurance and not licensed, hits anyone else, you can still be sued as part of the *insured*. Check into it, but I would be getting out of that triangle in a hurry.<BR>Best of Luck!!<P>Trueheart

Welp ... I'm going to cancel the insurance tomorrow (Thursday). Thank you for your help, Everyone. You guys are great, very helpful.<P>So now I have a side bar question. Hi Jo,<P>Well, I did. Sent up warning flags all over the place. You know actually having to be responsible for another bill that could jeporadize his work? Oh I got blamed for that one also. I said nope, if you need insurance I am sure OW can help or you can squeeze $$ out of that turnip of a job of yours. Ohhhh lordy ....<P>I talked to the auto insurance agent. She was very very friendly and chatty. She asked me where my H lived now that we're D, I told her and she responded that he will be paying at least 25% higher rates due to the location. (thug and gangsterville).<P>I gave her my scenario (OW driving car without license) but stated it was a "Friend's Situation", she told me that ABSOLUTELY "I" would be held liable if the OW was to get into an accident. Then she laughed, she knew it was my situation.<P>So thanks guys for the kick in the pants to do this. I would have hated to be sued. OW frequents bars alot (drinking and driving?). And now that I think of it, my H was only looking out for himself AGAIN!!! I could have been held liable for his mess up ... yet once more. Jeeez!<P>Please stay tuned. Good for you Resilient,<P>Earlier someone asked if your name is on the title or lien of any of the vehicles your XWS has? You did not respond so... Just a gentle reminder that if so, make sure you get your name off of them. <P>Right now we are having a problem with this. STL's XW apparently never transfered her vehicle to her name. Now she gave it to her OM's son. The other day he got mail from the state. There was a photo of the car running a red light. He is responsible because the car is in his name still.
