If we seperate, if anything , I would steer us to a marriage agreement which is legal in Florida, if Both parties agree on the settlement..........But he says I WILL NOT BE ENTITLED TO HIS Social Security when he get is next yr., I have heard that I will get 1/2 regardless whether we are together or not....... Anyone that has gone down this route, help me out here..........Thants

If you have been married for 10 yrs., you are entitled to half of his S.S. whether still married, separated, or divorced.

If separation is the direction you are going you should get a consultation with an attorney to get a better understanding of your rights.

But, I think that also may depend on your age. I don't think you can collect until you reach retirement age. A simple call to the Social Security office will answer those questions. That number is in the blue federal government section close to the front of the phone book.

You can do a search on Google that will bring up the laws regarding divorce and settlements in Florida.
