once joint custody is given can it be modified to primary if one parent relocates? Both X and I have joint and we both live in different states however, now he has moved futher out, more travel time and more travel expense, can it be modified to primary custody.

Nezi - This is highly state-dependent. In my state, the requirement is for 120 days notice if one parent decides to move out of the local area with the child(ren), so that custody arrangements can be made. I would suggest that it's appropriate for a change in custody. Not necessarily to sole custody, though. You might end up with a school year/summer split, for example, or some other arrangement.

I would suggest that you check with your lawyer or a legal center if you're not able to afford a lawyer.
