My attorney wasn't clear on this. My husband moved to another state. I filed for a divorce, we are changing it to a legal separation I believe if he agrees to a certain amount of child support, plus how we'll split assets in the case of a divorce. Likely we'll end up divorce, this is just my easy way out without fighting with each other in divorce court. But we'll see if we can figure it out without a legal battle this month...
Anyways my little boy is 21 months old. Of course I'll get custody of him since he left the state. The attorney said I could make it so I supervise visitations at first, just leaving an hour here and there. He's only been with his child six or so times in the past year. But as my boy gets older he'll be able to have him alone although he'll have to pay costs to travel here to see him in lieu of paying less child support.
I think my husband is a borderline alcoholic, but I'd have no way of proving he drinks too much. I read an AA book, and it seems like he might not be but he's on the edge, meaning if he keeps drinking and drinking he could become one. When he drinks he's controlled, he was coming home at night, needing a drink, going in the basement and drinking by himself. He never went to bars that I knew of but would drink at friends houses. He lost a job and even admitted since I left him he was drinking more then ever. Now he says he's not drinking a lot. I have no way of knowing.
So what happens in the future if my boy goes to his state for a summer? And how many weeks do they consider a summer? If we make a separation agreement to him visiting him here in my state once a month and more if we agree upon it? What about 3-4 years down the line, my ex will have a new girlfriend or wife, I don't know. Or he could be an old crazy bachelor living in a small town drinking day and night - I dont' want my son around it. He agreed to quit drinking and go to weekly counseling sessions, plus adress his control and nit picking during our legal separation if that's what we do. He doesn't want a divorce, I don't want to move to his state and I can't as I have a business, and if I moved I'd be stuck there, state laws would say then that I couldn't leave his state. I've lived here in our state for 15 years.
I think my husband will be a good father. He loves his boy. I used to think I'd keep it limited by my son loves being with his dad too. It's best that he has time with him. We had some fighting in our marriage, it brought out the worst of my husband and I. I don't want to punish a child over that. I drink now and then too, but I don't understand why he has to drink all the time, it's his way of unwinding as a banker, but it's a crutch either way.
