I am currently fighting for a divorce from my husband. He has been arrested twice now, once for stealing city property and the other for being under the influence of drugs (which I called him in by dialing 911). The night I called 911, the police suggested to me that I pack up our 2 year daughter and leave him. I also made note to the 911 dispatcher he had attempted assult against me in front of our daughter and attempted suicide in the bathroom. We were living in a hotel at the time. That night, after he was arrested, I proceeded to take the police advice and leave him. Her and I are now in a 2 bedroom apartment, and she attends day-care. He was a stay home dad while I work full time. He currently has 3 college degrees, and very well could get a job, just refused to. He is a pot and meth user, even though he says he has quit. I have pictures of the holes in the walls he made, along with pictures of his drugs. After he got out of jail, we came to an agreement as far as divorce is concerned. I get primary custody of our daughter and he gets her every other weekend. Because we were living ina hotel, we had no assests to divide, not to mention, because he failed to pay our storage unit for 4 months, we lost all of our furniture we had while living in northern california 4 years ago. I also agreed to pay him $500 a month and keep himon my health insurance until he gets a solid paying job. Right now he recycles metal, which is all under the table. I have started my liffe over with my daughter. His lawyer is now saying that I abandoned him, that I own him allimony, spousal support, and demanding custody of our daughter. Everyone I work with tells me he doesn't stand a chance to get her or anything from me. I filed out our divorce papers online, but have not had the financial backing to file them. He has signed them though, along with the original agreement we came upon. Now, I'm afraid I may lose my daughter to him, and own him big time. Everyone says that the state of California votes for the mother for custody. Like I mentioned, he has no job, still lives in the hotel, and is still using drugs. All charges against him, both the stealing and drug usage was dropped. He passes all drug tests. A lawyer I spoke to said that I could request a hair folical test to prove he's a meth user. Can anyone give me some information? I am breaking down in tears, with no lawyer. He fights me every day, one minute being nice, one minute being evil. I have verified with my cell phone company that I can get a court sopina request for the text mesages he has sent me. Not only are they vulger to me, he has threatened the life of a co-worker of mine. What can I do? Thanks!

you need to get a lawyer.....

the lawyer speaking for your husband...will tell you allll kinds of crap....

sounds pretty routine...

and lets be honest...how good can an underthetable meth uses who collects metal ....get as a really top notch lawyer...

uhhhh not so much...

you got police records..
you get the transcripts...

but first you seek and find legal aide...

try to calm down and save yourself the emotional trauma that is wrapped in lawyer speak...

get a lawyer
get control that way....

I know that's what I need to do... get a good lawyer. I wanted to end our marriage peacefully, or as peacefully as possible. A man who uses drugs and has no job, but has 3 degrees can't get a whole lot of support, right?!?! That's what I need to keep telling myself! The lawyer he has is a family lawyer, and not even in California, which is where we live. It's just so scary to know I may loose my child to someone who can't take care of her, not to mention wanted me to abort her when I was pregnant. Thanks for the advice!

He's been arrested twice. The first time was for stealing city property and trying to recycle it back to a metal recycling center. Turns out, the item he stole was numbered, and came up missing. DUH!!! The second time, I actually had him arrested. He attempted assult on me (in front of our daught), attempted suicide, and does drugs. He was tripping big time that night, and I had had enough!

He threatened the life of my co-worker because he thinks that the 2 of us are trying to set him up. While I was away on a business trip, he used my company vehicle to steal some more metal for him to get money My co-worker helped my daughter and move into our new apartment, so my husband got very angry that I had that particular co-worker at my house.

ok........he is NOT gonna be able to get your daughter. Any judge who would give him custody would be on drugs. Dont worry, get a lawyer, hes not gonna be able to get her, and I think u have to be married 10 or more years to get alimony from some one.

We've only been married since June of last year. I have the thought deep down in my heart that I shouldn't lose her, but it's just sooooo scary. He didn't want her while I was pregnant with her, wanted me to abort her, and now wants to take her from me. That's what I don't understand. I really think he's bi-polar.

No he is doing it out of spite.......he doesnt want that responsibility, he wants to hurt you through her. Theres no way he can get any alimony or spousal support since you havent been married very long.

Yes, he's raised her for the past 2 years, but what good did he do for her. She was constantly dirty, filthy, barefoot, and always left alone in our room while he was in the bathroom doing drugs. Can I prove it, I have pictures of the drugs, I have my 911 call report, and the police that were there that said to leave, he's a tweaker. I honestly believe that the marriage was for our families more than for ourselves.
