Starting a new thread because I'm just looking for a simple answer if there is one and some may not have been following the other one (don't blame you - I was pretty distraught there). It is pretty obvious I need to take defensive action and fast. In Canada, the separation agreement is the legal document that counts. WH and I have verbally agreed on a settlement but he's a lying cheating scumbag right now and since I'm on the roller coaster ride from ******, I am very prone to screwing even this up. I've asked him for written papers to sign but he's too busy with OW to be bothered with trifles like his responsibilities and obligations and such. So I would like to write something up myself and at least get it legalized.

Can anybody send me a template of their separation agreement? Even if you are Canadian but from another province, it will help. Feel free to delete any and all personal information. I'm just looking for the format. I will have my version checked by a lawyer but it's a difference of about $1000 if I write it myself or have the lawyer do everything.

I hope you found a really good cut-throat divorce lawyer. It might be in your best interest to fork out the money for the lawyer to help you. I wish there was someone here to help you. If it comes from a lawyer he might sit up an pay attention. Maybe he thinks you are just blowing smoke? I hope someone answers you soon, sorry I'm not any help.

Tabby, if I were you, I wouldn't try and cut corners with a d0-it-yourself seperation. I would get the meanest SOB you can find and get yourself PROTECTED. You are under ASSAULT and you will lose MUCH MORE than a measly $1000 if you don't get some help. if your H has been carefully planning this and hiding your money, then you need to get some good help.

I've spoken to 3 different lawyers. Apparently, Canada is the land of no-fault divorce. The assets go 50-50 no matter who does what. Even in cases of abuse. The only way to do better than that is to do the separation agreement yourself. As long as both parties agree, the assets/debts can be split any way. The SA is legally binding. My lyin' cheatin' scum-bag WH (LCSBWH from now on) has verbally agreed to a very minimal buyout. But it means nothing until we both sign an agreement and get it witnessed.

I can't remember how far I got in the OWH story when I had to cut out suddenly. I'll go back to that thread and finish it. It was a very interesting and enlightening discussion.

Pepperband, I am already highly suspicious about hidden assets. However, this is the only way to screw up the SA according to 3 different lawyers. If he does have them hidden and I find out later, he will be screwed.

He's a dairy manager at a small grocery chain. I make more money than him. He can get me for spousal support which he has verbally agreed not to go for. I can get him for child support and tuition which he has verbally agreed to give me in the form of a lump sum payment out of his buyout. He's also verbally agreed to a buyout based on the price we bought the house for 8 years ago rather than what it would be worth today. And he has also verbally agreed to take his truck debt with him. The only contents of the house he has verbally agreed to take are his home entertainment system (worth probably over $10K), a futon, 3 coffee tables and the toaster and microwave. I'm keeping everything else. I also have a horse which balances out the home theater system.

Tabby, I am in BC. There are a LOT of things that you need to put in a SA. A LOT. I can help you. However, The list of questions would be lengthy. I am now representing myself in Court after 2 years of endless legal fees. And when I went to the courthouse, they suggested I apply for a job! lol. THe registrar said I knew as much as some lawyers!. If you are interested, we can talk on Yahoo first. My name in Yahoo chat is fightingalong_again.

My WH went to a lawyer to go about getting a SA, but I have flat out told him I refuse to go along with it.

I am not going to make things easy for him. And, for some reason, he does not seem to mind that sometimes. I really don't know what my rights are here in Ontario, but he seems to be going with the flow, so I just let it be... for now.

He has been back and forth since day one (I want this, but now I don't) so, I have told him that OUR things are in OUR home waiting for US to figure out where we are going.

I am refusing to allow him in his fog state of mind make decisions that will affect our future.

He is okay with that one minute, then angry again the next. And, it didn't help having my sister tell him yesterday to hurry and get the whole lawyer thing going.

Anyway, be firm, and do not back down.
