This would be an interesting turn of events given MANY if not most hospitals in most states are Catholic Hospitals..

Could Result in Closing Catholic Hospitals

Quote
Barack Obama told Planned Parenthood in July 2007 that the first piece of legislation he would sign would be the so-called Freedom of Choice Act, a bill that would overturn pro-life laws nationwide. One little-discussed aspect of the ramifications of the bill could see the closing of Catholic hospitals.

But the bill could have the effect of closing down Catholic hospitals that refuse to do abortions. Here's how:

As Cardinal Justin Rigali of the Archdiocese of Philadelphia warned in September, the FOCA bill "forbids government at all levels to 'discriminate' against the exercise of this [abortion] right 'in the regulation or provision of benefits, facilities, services, or information.'"

"For the first time, abortion on demand would be a national entitlement that government must condone and promote in all public programs affecting pregnant women," the Catholic official explained.

Michael Moses, a top attorney for the U.S. Conference of Catholic Bishops, adds that the language of FOCA is so far-reaching that it will remove any conscience clause measures from state laws that protect doctors, hospitals and medical professionals who don't want to be involved in abortions.

Moses' reading of the proposed legislation is that if abortion is a fundamental right that can't ever be infringed, then every hospital and medical center must do abortions -- including Catholic and other religious or private hospitals that object to do them.

John Vennari, the editor of the Catholic Family News publication, points out that the measure could easily put Catholics hospitals out of business that want to continue opting out of doing abortions rather than violate their religious beliefs

"This aspect of Obama's candidacy has been eclipsed by endless talk about the economy," Vennari writes.

He urges Catholic leaders to discuss this very real threat.

The Supreme Court will not allow providers of care to basically be forced to provide abortions.
My brother has a medical practice with thousands of patients and they have never written a referral for an abortion (except in cases where the mothers life was at stake).
It is scary...but I just don't see it happening.

It would seem that forcing anyone to perform abortions would actually go against pro-choice - as it should be the individual's (doctor) or institution's (hospital since it's privately funded there) choice to offer or not offer whatever services they want.

The issue MAY not be individual Doctors, but it most definitely could impact the corporate position of hospitals.

And I agree, it IS scary and is one of the reason why I've mentioned that particular piece of legislation in a lot the pre-election postings.

Do you understand what FOCA is??

It would basically tell Hospitals and Doctors we don't care what your beliefs are, it's the patients right to have an abortion and if YOU don't provide that service you will be fined.

So instead of being fined or sued by a patient FOR NOT performing an abortion on demand, merely because the patient wants it..they will close their doors..as opposed to be forced to do something they disagree with.

Unfortunately it doesn't work that way, because even then they would not be able to help the poor, whose bills are paid for by the government, they would have to deny them any type of care as well, unless they did not bill for their services at all.

10) Legal and practical barriers to the full range of reproductive services endanger women's health and lives. Incremental restrictions on the right to choose imposed by Congress and State legislatures have made access to reproductive care extremely difficult, if not impossible, for many women across the country. Currently, 87 percent of the counties in the United States have no abortion provider

Why?? Because doctors in those areas REFUSE to perform them, there is not one state the has a total ban on abortions, they only have certain restrictions such as parental consent for minors, no abortions after a certain trimester and no federal funding for abortions (meaning they have to pay for them if they want them).

If the patient is paying, doctors can refuse to perform them, if the US goes to a State funded Universal Health care for everyone, then doctors at all hospitals would be required by law to perform abortions, even IF it goes against their own personal beliefs.

Hospitals do not have to give doctors access to their facility, doctors do not have a 'right' to work in this country, so if the government says abortions are to be federally funded by our tax dollars through universal health care (or even indigent care) then ALL hospitals would be receiving federal funds including Catholic/Baptist Hospitals..so if they refuse to perform abortions they could be sued/fined/forced to close down anyway So they have a choice to make..close their doors or perform abortions which goes against their beliefs.

SEC. 6. RETROACTIVE EFFECT.
This Act applies to every Federal, State, and local statute, ordinance, regulation, administrative order, decision, policy, practice, or other action enacted, adopted, or implemented before, on, or after the date of enactment of this Act.

In other words, this would remove the States Rights to choose which abortions to ban..if any..

Barack Obama's "Freedom of Choice Act" Would Mean 125K More Abortions

FOCA is usually reported as “codifying Roe v. Wade,” but it is much more. Since the Webster and Casey decisions in 1989 and 1992, the Supreme Court has allowed states to limit abortion somewhat by such things as requiring parental involvement and informed consent, prohibiting government funding of most abortion, and more recently outlawing most partial birth abortions.

But FOCA tolerates none of this. Advocates and opponents of FOCA all agree that the bill would nullify every legal limit on abortion, state, federal or otherwise. Americans United for Life, as well as the Family Research Council, explain this fact in great detail. Abortion advocates who want FOCA concur: NOW, NARAL, Planned Parenthood, and FOCA sponsor Senator Barbara Boxer all contend that FOCA will strike down all state pro-life laws.

If your teenage child gets pregnant, they can have their friend from school or a teacher take them to get an abortion without your ever knowing or having any say in the matter, they won't need your consent, you as the parent have NO RIGHT to know what your child is doing..

TR, on another thread there have statements made that "Nationalized Healthcare" would NOT be "Marxist" even if they begrudgingly admit that it would be Socalism.

Regardless, this FOCA legislation WOULD put the lives of all "unwanted" pregnancies into a)the sole hands of women regardless of marital status or age, and b)the hands of the federal government ALONE, clearly "overstepping" the Contstitutional limits ON the Federal Government.

THAT is just another "Step" in the process of moving FROM capitalism TO Socialism...and it would appear to be "over the line" into Communism, let alone Marxism. "The STATE knows what is best and you have NO say in the matter."

So much we still don't know about Obama as he was successful in hiding and not answering so many questions. Makes me wonder just what WAS in his thesis that he still refuses to be allowed to be released.

The Catholic hospital in my area does not provide ANY obstetric services. No deliveries. No abortions. They viewed the ending of all obstetric services as a way to avoid the issue of abortions. They have held this position for the last 25 years or so - with the exception of about 3 years when they did do deliveries.

That is the way it is where I live.

So many hospitals are going the "Specialty" route. They specialize in certain areas...and that is the ONLY type of care you can get there. Example: the hospitals that "specializes" in vascular treatments are not going to have a problem.

The not-for-profit acute care community hospitals are slowly disappearing...if not being gobbled up by giants like HCA.

The for-profits certainly won't have a problem with it.

The hospitals still owned by the Sisters are going to be the ones in a pickle.

Shoot...they just might sell to a for-profit medical group like one did in Cleveland.
