A husband is in jail charged under anti-hacking laws after getting access to his wife's email account on their shared computer. The husband suspected his wife of cheating and took matters into his own hands. Rochester News Report

Just to clarify your thread topic:
It seems that this is a public prosecution, not a suit brought by the WW (although she must have reported it in order for the DA to take it up).
I question the DA's judgement in prosecuting. The computer was shared and the password was written in a book to which the BS had access. Using the password to read the emails does not seem to me to fit the definition of "hacking" an account.
After a successful prosecution, would parents no longer be able to monitor their children's activities?
A jury might well acquit given the apparent widespread public sympathy for the BH, after which the BH could sue the DA, and perhaps even the FWW for adultery. The DA's career is hardly likely to flourish after this.
I should think that the DA will soon realise that it was unwise to bring this action.

WOW, how embarrassing for Michigan!! This likely spells the end of this over zealous prosecutor's career: In the Washington Post article on this story it said: Other lawyers in the Detroit area told the Free Press that this application of the law was ludicrous. One told the paper that if this case is applicable under the law, the state would also have to prosecute parents monitoring their children's Facebook accounts.

What will happen is the suit will be dropped, the prosecuter will be humiliated, and the WW's affair will be dragged through the press! Affair exposed!!

She reported it. And I do hope that the Prosecuter's office will have egg on it's face.
Understand this as well. She is a serial cheater. She cheated on ExH#1 with ExH#2 and cheated on H#3 with ExH #2 who will probably end up being exH#4!!!

Doing a google search on this prosecutor, Jessica Cooper, it seems she has done something just as boneheaded before!! Just this year, she charged an innocent woman with murdering her husband BEFORE the autopsy was complete. The autopsy revealed the man died of an "old boating injury." But the wife had been arrested by then and missed her husbands funeral because of this numbskull, overzealous prosecutor. Here are some of the comments from this article: "Was Jessica Cooper's maiden name Fife? Sounds like she was runnin around with her pistol and one bullet while Andy was in Mount Pilot." Did Oakland County Prosecutor Jessica Cooper jump the gun on charging wife with attorney's murder?

Here is one 'comment' that was left on a newsite and I have to agree wholeheartedly...
Sorry, but wives snoop on their husbands all the time so as far as I'm concerned turnabout is fair play. Besides, if you're cheating on your spouse, there should be no defense, no matter how it's found out. An expectation of privacy in marriage is not an expectation to be able to cheat if you so desire. Married people should not have that kind of protection of secrecy. If you fool around and are found out, you suffer the consequences, not charge your spouse with spying on you. That is ridiculous and it is time the government/law get the hell out of our bedrooms.

So, am I to understand that the hiring of a private detective to stalk a spouse and take photos showing "cheating" activities is not a privacy invasion, but reading spousal e-mail is?

This is a BUMP UP of a really old thread but I had to share the good news.... On July 19th, 2012 the malicious prosecution and persecution of Leon Walker by the Oakland County, Michigan prosecutor Jessica Cooper has finally ended. After 2.5 years and a trip to the Michigan Court of Appeals and back to Oakland County later for trial...the prosecution finally just inexplicably dropped it's case against Leon Walker for snooping on his then cheating wife's email account. Interesting timing, my friends. I'd been trying to figure out how to relate this story:
On 28 July, 2009, in our local court, I was extorted into accepting a plea deal on my criminal mischief charge: ACD after six months, but a "limited order of protection" to be reinstated for that period (the original having been vacated), because the (edit)(edit)(edit)...misguided...female ADA was out to prove how "tough" she was. (My recovering WW was verging on a nervous collapse for her part in this ongoing nightmare, so I reluctantly acquiesced.)
On 28 July 2012, the building in which that travesty was enacted was struck by a lightning-bolt strong enough to melt the air-conditioning system; blow out the electrical system; travel down to, and destroy, the submersible well pump; and fry every computer in the judges' chambers. (If only that ADA had been SITTING on -straddling? - some plumbing!)
