After 3 years of MIA H, I got the papers tonight.
The wedding date is off by 7 months. None of the kids birthdates are correct. He doesn't even have the correct address on the papers.
Is this some kind of sick joke? Can divorce papers be filed with this kind of discrepancies in the documentation? What now? <small>[ February 27, 2004, 07:33 AM: Message edited by: saucy ]</small>

MIA: as in he hasn't been back since he left three years ago. Not intending to imply any military service on his part.

Do you want to be divorced? If so, Photocopy the document, make the needed corrections on the copy and sign it. Or get a lawyer and file against him. Don't forget CS.
My X basically copied my filing, as if he'd have the info to file himself first.

I got the papers tonight Did you "get them" in the mail or were you served? If you received them in the mail, you don't have to do anything cuase it's not "official" unless you sign a waiver of service" which states you did receive the papers. (check with a lawyer to be sure) And you do not have to sign the waiver if you don't want to.

I definitely want the divorce. He hasn't seen the kids since he left. Him coming back isn't an option.
Papers were served. I didn't have to sign for them, but they were served by a law enforcement officer.

I don't know if it is common, but I can tell you that in my STBX's papers, he had our marriage date wrong (day and year!), our oldest child's birthday incorrect, and our youngest's child's name incorrectly spelled. He also had my maiden name incorrectly spelled. What a dope huh? Pays so much attention to details...NOT. Anyway, when I counterfiled and answered, I disagreed in my response and corrected it. Not that it would matter in a courtroom situation, but it sure says it all about how much attention he gave to important things in our family...
