I think he is trying to make this like he's not responsible for it. He's trying to hold on to the image of being a "nice" guy.

Just like the cheaters who try to force or manipulate the BS into being the one to file for divorce. Then they can tell everyone that "she/he divorced me". Your H sounds like he doesn't really want you to sign the divorce papers but he wants to be able to tell the OW "I filed, but she won't sign. There is nothing I can do." So he still gets to be married to you, keeping his options open, and doesn't have to commit to marrying her.
